A BILL
To require the Secretary of Health and Human Services
to award additional funding through the Sanitation Fa-
cilities Construction Program of the Indian Health Serv-
ice, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. INDIAN HEALTH SERVICE SANITATION FACILI-
3
TIES CONSTRUCTION PROGRAM FUNDING.
4
(a) FINDINGS.—Congress finds that—
5
(1) the COVID–19 crisis has highlighted the
6
lack of infrastructure and sanitation available in Na-
7
tive communities;

(2) addressing the Sanitation Facilities Defi-
1
ciency List of the Division of Sanitation Facilities
2
and Construction of the Indian Health Service in-
3
cluded in the report will—
4
(A) result in investments in necessary
5
water infrastructure; and
6
(B) improve health outcomes; and
7
(3) it is in the interest of the United States,
8
and it is the policy of the United States, that all ex-
9
isting and new Indian communities and Indian
10
homes be provided with safe and adequate water
11
supply systems and sanitary sewage waste disposal
12
systems as soon as practicable.
13
(b) DEFINITIONS.—In this section:
14
(1) REPORT.—The term ‘‘report’’ means the
15
fiscal year 2018 report of the Division of Sanitation
16
Facilities and Construction of the Indian Health
17
Service entitled ‘‘Annual Report to the Congress of
18
the United States on Sanitation Deficiency Levels
19
for Indian Homes and Communities’’.
20
(2) SECRETARY.—The term ‘‘Secretary’’ means
21
the Secretary of Health and Human Services, acting
22
through the Director of the Indian Health Service.

(c) ADDITIONAL FUNDING FOR SANITATION FACILI-
24
TIES.—

(1) IN GENERAL.—The Secretary shall award
1
additional funding under the Sanitation Facilities
2
Construction Program for the planning, design, con-
3
struction, modernization, improvement, and renova-
4
tion of water, sewer, and solid waste sanitation fa-
5
cilities that are funded, in whole or part, by the In-
6
dian Health Service through, or provided for in, a
7
contract or compact with the Indian Health Service
8
under the Indian Self-Determination and Education
9
Assistance Act (25 U.S.C. 5301 et seq.).
10
(2) PRIORITY
FOR
FUNDING.—In awarding
11
funding to sanitation facilities under paragraph (1),
12
the Secretary shall prioritize sanitation facilities
13
with the highest deficiency level, as established in
14
the report.
15
(d) AUTHORIZATION OF APPROPRIATIONS.—
16
(1) IN GENERAL.—There is authorized to be
17
appropriated to the Secretary to carry out this sec-
18
tion $1,335,000,000 for the period of fiscal years
19
2020 through 2024.
20
(2) REQUIREMENT.—Amounts made available
21
under paragraph (1) shall be in addition to any
22
amounts made available to carry out the purposes
