SHORT TITLE. 3 This Act may be cited as the ‘‘Suicide Training and 4 Awareness Nationally Delivered for Universal Prevention 5 Act of 2020’’ or the ‘‘STANDUP Act of 2020’’. 6 SEC. 2. STUDENT SUICIDE AWARENESS AND PREVENTION 7 TRAINING. 8 (a) IN GENERAL.—Title V of the Public Health Serv- 9 ice Act is amended by inserting after section 520A of such 10 Act (42 U.S.C. 290bb–32) the following: 11 ‘‘SEC. 520B. STUDENT SUICIDE AWARENESS AND PREVEN- 12 TION TRAINING POLICIES. 13 ‘‘(a) IN GENERAL.—As a condition on receipt of 14 funds under section 520A, each State educational agency, 15 local educational agency, and Tribal educational agency 16 that receives such funds, directly or through a State or 17 Indian Tribe, for activities to be performed within sec- 18 ondary schools, including the Project AWARE State Edu- 19 cation Agency Grant Program, shall— 20 ‘‘(1) establish and implement a school-based 21 student suicide awareness and prevention training 22 policy; and 2 ‘‘(3) collect and report information in accord- 3 ance with subsection (c). 4 ‘‘(b) SCHOOL-BASED STUDENT SUICIDE AWARENESS 5 AND PREVENTION TRAINING POLICY.—A school-based 6 student suicide awareness and prevention training policy 7 implemented pursuant to subsection (a)— 8 ‘‘(1) shall be evidence-based; 9 ‘‘(2) shall be culturally and linguistically appro- 10 priate; 11 ‘‘(3) shall provide evidence-based training to 12 students in grades 6 through 12, in coordination 13 with school-based mental health service providers as 14 defined in section 4102(6) of the Elementary and 15 Secondary Education Act of 1965, if applicable, re- 16 garding— 17 ‘‘(A) suicide education and awareness, in- 18 cluding warning signs of self-harm or suicidal 19 ideation; 2 ‘‘(5) may last for such period as the State edu- 3 cational agency, local educational agency, or Tribal 4 educational agency involved determines to be appro- 5 priate; 6 ‘‘(6) may be implemented through any delivery 7 method, including in-person trainings, digital 8 trainings, or train-the-trainer models; and 9 ‘‘(7) may include discussion of comorbidities or 10 risk factors for suicidal ideation or self-harm, includ- 11 ing substance misuse, sexual or physical abuse, men- 12 tal illness, or other evidence-based comorbidities and 13 risk factors. 14 ‘‘(c) COLLECTION OF INFORMATION AND REPORT- 15 ING.—Each State educational agency, local educational 16 agency, and Tribal educational agency that receives funds 17 under section 520A shall, with respect to each school 18 served by the agency, collect and report to the Secretary 19 the following information: 20 ‘‘(1) The number of student trainings con- 21 ducted. 22 ‘‘(2) The number of students trained, 23 disaggregated by age and grade level. 24 VerDate Sep 11 2014 05:57 Oct 01, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H7293.RFS H7293 kjohnson on DSK79L0C42PROD with BILLS 5 HR 7293 RFS ‘‘(3) The number of help-seeking reports made 1 by students after implementation of such policy. 2 ‘‘(d) EVIDENCE-BASED PROGRAM LISTING.—The 3 Secretary of Health and Human Services shall coordinate 4 with the Secretary of Education to make publicly available 5 the policies established by State educational agencies, local 6 educational agencies, and Tribal educational agencies pur- 7 suant to this section and the training that is available to 8 students and teams pursuant to such policies, including 9 identification of whether such training is available to 10 trainees at no cost. 11 ‘‘(e) IMPLEMENTATION TIMELINE.—A State edu- 12 cational agency, local educational agency, or Tribal edu- 13 cational agency shall establish and begin implementation 14 of the policies required by subsection (a)(1) not later than 15 the beginning of the third fiscal year following the date 16 of enactment of this section for which the agency receives 17 funds under section 520A. 18 ‘‘(f) DEFINITIONS.—In this section and section 19 520B–1: 20 ‘‘(1) The term ‘evidence-based’ has the meaning 21 given to such term in section 8101 of the Elemen- 22 tary and Secondary Education Act of 1965. 23 ‘‘(2) The term ‘local educational agency’ has 24 the meaning given to such term in section 8101 of 25 VerDate Sep 11 2014 05:57 Oct 01, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H7293.RFS H7293 kjohnson on DSK79L0C42PROD with BILLS 6 HR 7293 RFS the Elementary and Secondary Education Act of 1 1965. 2 ‘‘(3) The term ‘State educational agency’ has 3 the meaning given to such term in section 8101 of 4 the Elementary and Secondary Education Act of 5 1965. 6 ‘‘(4) The term ‘Tribal educational agency’ has 7 the meaning given to the term ‘tribal educational 8 agency’ in section 6132 of the Elementary and Sec- 9 ondary Education Act of 1965. 10 ‘‘SEC. 520B–1. BEST PRACTICES FOR STUDENT SUICIDE 11 AWARENESS AND PREVENTION TRAINING. 12 ‘‘The Secretary of Health and Human Services, in 13 consultation with the Secretary of Education and the Bu- 14 reau of Indian Education, shall— 15 ‘‘(1) publish best practices for school-based stu- 16 dent suicide awareness and prevention training, pur- 17 suant to section 520B, that are based on— 18 ‘‘(A) evidence-based practices; and 19 ‘‘(B) input from relevant Federal agencies, 20 national organizations, Indian Tribes and Trib- 21 al organizations, and related stakeholders; 22 ‘‘(2) publish guidance, based on the best prac- 23 tices under paragraph (1), to provide State edu- 24 cational agencies, local educational agencies, and 25 VerDate Sep 11 2014 05:57 Oct 01, 2020 Jkt 099200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H7293.RFS H7293 kjohnson on DSK79L0C42PROD with BILLS 7 HR 7293 RFS Tribal educational agencies with information on stu- 1 dent suicide awareness and prevention best prac- 2 tices; 3 ‘‘(3) disseminate such best practices to State 4 educational agencies, local educational agencies, and 5 Tribal educational agencies; and 6 ‘‘(4) provide technical assistance to State edu- 7 cational agencies, local educational agencies, and 8 Tribal educational agencies.’’. 9 SEC. 3. EFFECTIVE DATE. 10 The amendments made by this Act shall only apply 11 with respect to applications for assistance under section 12 520A of the Public Health Service Act (42 U.S.C. 290bb– 13 32) that are submitted after the date of enactment of this 14 Act. 15 Passed the House of Representatives September 29, 2020.
