IN THE HOUSE OF REPRESENTATIVES

Mr. DUNCAN (for himself, Mr. GOSAR, Mr. ARMSTRONG, and Mrs. RODGERS
of Washington) introduced the following bill; which was referred to the
Committee on Natural Resources, and in addition to the Committee on
Energy and Commerce, for a period to be subsequently determined by the
Speaker, in each case for consideration of such provisions as fall within
the jurisdiction of the committee concerned
A BILL
To prohibit a moratorium on the use of hydraulic fracturing.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Protecting American
4
Energy Production Act’’.

SEC. 2. PROTECTING AMERICAN ENERGY PRODUCTION.

(a) SENSE OF CONGRESS.—It is the sense of Con-
7
gress that States should maintain primacy for the regula-
8
tion of hydraulic fracturing for oil and natural gas produc-
9
tion on State and private lands.

(b) PROHIBITION ON DECLARATION OF A MORATO-

RIUM
ON HYDRAULIC FRACTURING.—Notwithstanding
2
any other provision of law, the President may not declare
3
a moratorium on the use of hydraulic fracturing unless
4
such moratorium is authorized by an Act of Congress.
