A BILL
To direct the Secretary of Agriculture to transfer certain
National Forest System land in the State of Washington
to Skamania County, Washington.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Wind River Adminis-
4
trative Site Conveyance Act’’.
5
SEC. 2. DEFINITIONS.
6
In this Act:
7
(1) COUNTY.—The term ‘‘County’’ means the
8
Skamania County, Washington.

(2) MAP.—The term ‘‘map’’ means the map en-
1
titled ‘‘Wind River Administrative Site Conveyance
2
Proposal’’ and dated February 7, 2020.
3
(3) SECRETARY.—The term ‘‘Secretary’’ means
4
the Secretary of Agriculture, acting through the
5
Chief of the Forest Service.
6
SEC. 3. CONVEYANCE OF LAND AND IMPROVEMENTS.
7
(a) IN GENERAL.—If the County submits a written
8
request to the Secretary not later than 180 days after the
9
date of enactment of this Act, the Secretary shall, not
10
later than 24 months after the date of the enactment of
11
this Act, convey to the County all right, title, and interest
12
of the United States in and to the approximately 23.4
13
acres of National Forest System land, related infrastruc-
14
ture, and all improvements, as generally depicted as ‘‘pro-
15
posed conveyance’’ on the map.

(b) MAP.—
17
(1) AVAILABILITY OF MAP.—The map shall be
18
kept on file and available for public inspection in the
19
appropriate office of the Forest Service.
20
(2) CORRECTION OF ERRORS.—The Secretary
21
may correct minor errors in the map.
22
(c) TERMS
AND
CONDITIONS.—The conveyance
23
under subsection (a) shall be—
24
(1) subject to valid existing rights;

(2) notwithstanding any other provision of law,
1
made without consideration;
2
(3) made by quitclaim deed;
3
(4) subject to a right-of-way and restrictive
4
easement reservation of a width to be determined by
5
the Secretary, for the protection of the Pacific Crest
6
National Scenic Trail;
7
(5) completed in accordance with the Forest
8
Service Facility Realignment and Enhancement Act
9
of 2005 (16 U.S.C. 580d, et seq.), except that sec-
10
tion 504(b) and (c) of that Act shall not apply;
11
(6) subject to right-of-way reservations made
12
pursuant to section 507 of the Federal Land Policy
13
and Management Act of 1976 (43 U.S.C. 1767);
14
and
15
(7) subject to any other terms and conditions
16
as the Secretary determines appropriate.

(d) FEDERAL PROPERTY DISPOSAL.—Chapter 5 of
18
subtitle I of title 40, United States Code, shall not apply
19
to the conveyance under subsection (a).
20
(e) HAZARDOUS MATERIALS.—With respect to the
21
conveyance under subsection (a), the Secretary—
22
(1) shall meet disclosure requirements for haz-
23
ardous substances, pollutants, or contaminants
24
under section 120(h) of the Comprehensive Environ-

mental Response, Compensation, and Liability Act

of 1980 (42 U.S.C. 9620(h)); and
2
(2) shall not otherwise be required to remediate
3
or abate the hazardous substances, pollutants, or
4
contaminants disclosed pursuant to paragraph (1).
5
(f) CLOSING COSTS.—As a condition for the convey-
6
ance under subsection (a), the County shall pay all closing
7
costs associated with the conveyance, including for—
8
(1) title insurance and title search; and
9
(2) any applicable inspection fees, escrow fees,
10
attorneys fees, and recording fees.

(g) SURVEY.—
12
(1) IN GENERAL.—The exact acreage and legal
13
description of the National Forest System land to be
14
conveyed under subsection (a) shall be determined
15
by a survey satisfactory to the Secretary.
16
(2) COSTS
OF
SURVEY.—The Secretary shall
17
bear all costs associated with the survey under para-
18
graph (1).
19
(h) USE OF LAND.—
20
(1) IN GENERAL.—The lands and related infra-
21
structure conveyed under subsection (a) shall be
22
maintained by the County pursuant to standards es-
23
tablished by the Secretary of the Interior under sec-
24
tion 306101 of title 54, United States Code.

(2) REVERSION.—If any portion of the land
1
conveyed under subsection (a) is used in a manner
2
that is inconsistent with the use described in para-
3
graph (1), the land shall, at the discretion of the
4
Secretary, revert to the United States.
