To amend the Forest and Rangeland Renewable Resources Planning Act
of 1974 and the Federal Land Policy and Management Act of 1976
to provide that the Secretary of Agriculture and the Secretary of the
Interior are not required to reinitiate consultation on a land management
plan or land use plan under certain circumstances, and for other pur-
poses.

duced the following bill; which was read twice and referred to the Com-
mittee on Environment and Public Works
A BILL
To amend the Forest and Rangeland Renewable Resources
Planning Act of 1974 and the Federal Land Policy and
Management Act of 1976 to provide that the Secretary
of Agriculture and the Secretary of the Interior are
not required to reinitiate consultation on a land manage-
ment plan or land use plan under certain circumstances,
and for other purposes.
Be it enacted by the Senate and House of Representa-

SECTION 1. NO ADDITIONAL CONSULTATION REQUIRED.

(a) FOREST SERVICE PLANS.—Section 6(d) of the
2
Forest and Rangeland Renewable Resources Planning Act
3
of 1974 (16 U.S.C. 1604(d)) is amended by adding at the
4
end the following:

‘‘(3) NO
ADDITIONAL
CONSULTATION
RE-
6
QUIRED AFTER NEW INFORMATION BECOMES AVAIL-
7
ABLE.—Notwithstanding any other provision of law,
8
the Secretary shall not be required to reinitiate con-
9
sultation under section 7(a)(2) of the Endangered
10
Species Act of 1973 (16 U.S.C. 1536(a)(2)) or sec-
11
tion 402.16 of title 50, Code of Federal Regulations
12
(or a successor regulation), on a land management
13
plan approved, amended, or revised under this sec-
14
tion on the basis of new information relating to a
15
species listed as threatened or endangered or critical
16
habitat designated under that Act (16 U.S.C. 1531
17
et seq.).’’.

(b) BUREAU OF LAND MANAGEMENT PLANS.—Sec-
19
tion 202 of the Federal Land Policy and Management Act
20
of 1976 (43 U.S.C. 1712) is amended by adding at the
21
end the following:

‘‘(g) NO ADDITIONAL CONSULTATION REQUIRED
23
AFTER NEW INFORMATION BECOMES AVAILABLE.—Not-
24
withstanding any other provision of law, the Secretary
25
shall not be required to reinitiate consultation under sec-
