EXTENSION OF FEDERAL SURFACE TRANSPOR- 3 TATION PROGRAMS. 4 (a) IN GENERAL.—Except as otherwise provided in 5 this Act, the requirements, authorities, conditions, eligi- 6 bilities, limitations, and other provisions authorized under 7 VerDate Sep 11 2014 22:38 Aug 06, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H7248.IH H7248 pbinns on DSKJLVW7X2PROD with BILLS 4 •HR 7248 IH the covered laws, which would otherwise expire on or cease 1 to apply after September 30, 2020, are incorporated by 2 reference and shall continue in effect through September 3 30, 2025. 4 (b) AUTHORIZATION OF APPROPRIATIONS.— 5 (1) HIGHWAY TRUST FUND.— 6 (A) HIGHWAY ACCOUNT.—There is author- 7 ized to be appropriated from the Highway Ac- 8 count for each of fiscal years 2021 through 9 2025, for each program with respect to which 10 amounts are authorized to be appropriated from 11 such account for fiscal year 2020, an amount 12 equal to 110 percent of the amount authorized 13 for appropriation with respect to the program 14 from such account under the covered laws for 15 fiscal year 2020. 16 (B) MASS TRANSIT ACCOUNT.—There is 17 authorized to be appropriated from the Mass 18 Transit Account for each of fiscal years 2021 19 through 2025, for each program with respect to 20 which amounts are authorized to be appro- 21 priated from such account for fiscal year 2020, 22 an amount equal to 110 percent of the amount 23 authorized for appropriation with respect to the 24 VerDate Sep 11 2014 22:38 Aug 06, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H7248.IH H7248 pbinns on DSKJLVW7X2PROD with BILLS 5 •HR 7248 IH program from such account under the covered 1 laws for fiscal year 2020. 2 (2) GENERAL FUND.—There is authorized to be 3 appropriated for each of fiscal years 2021 through 4 2025, for each program with respect to which 5 amounts are authorized to be appropriated for fiscal 6 year 2020 from an account other than the Highway 7 Account or the Mass Transit Account under the ti- 8 tles specified in subsection (e)(1)(A), an amount 9 equal to the amount authorized for appropriation 10 with respect to the program under such titles for fis- 11 cal year 2020. 12 (c) USE OF FUNDS.—Subject to section 1004(b), 13 amounts authorized to be appropriated for each of fiscal 14 years 2021 through 2025 with respect to a program under 15 subsection (b) shall be distributed, administered, limited, 16 and made available for obligation in the same manner as 17 amounts authorized to be appropriated with respect to the 18 program for fiscal year 2020 under the covered laws. 19 (d) OBLIGATION LIMITATION.—Subject to section 20 1004(d), a program for which amounts are authorized to 21 be appropriated under subsection (b)(1) shall be subject 22 to a limitation on obligations for each of fiscal years 2021 23 through 2025 in the same amount and in the same man- 24 VerDate Sep 11 2014 22:38 Aug 06, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H7248.IH H7248 pbinns on DSKJLVW7X2PROD with BILLS 6 •HR 7248 IH ner as the limitation applicable with respect to the pro- 1 gram for fiscal year 2020. 2 (e) DEFINITIONS.—In this section, the following defi- 3 nitions apply: 4 (1) COVERED LAWS.—The term ‘‘covered laws’’ 5 means the following: 6 (A) Titles I, III, IV, V, and VI of division 7 A of the FAST Act (Public Law 114–94). 8 (B) Division A, division B, subtitle A of 9 title I and title II of division C, and division E 10 of MAP–21 (Public Law 112–141). 11 (C) Titles I, II, and III of the SAFETEA– 12 LU Technical Corrections Act of 2008 (Public 13 Law 110–244). 14 (D) Titles I, II, III, IV, V, and VI of 15 SAFETEA–LU (Public Law 109–59). 16 (E) Titles I, II, III, IV, and V of the 17 Transportation Equity Act for the 21st Century 18 (Public Law 105–178). 19 (F) Titles II, III, and IV of the National 20 Highway System Designation Act of 1995 21 (Public Law 104–59). 22 (G) Title I, part A of title II, title III, title 23 IV, title V, and title VI of the Intermodal Sur- 24 VerDate Sep 11 2014 22:38 Aug 06, 2020 Jkt 099200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H7248.IH H7248 pbinns on DSKJLVW7X2PROD with BILLS 7 •HR 7248 IH face Transportation Efficiency Act of 1991 1 (Public Law 102–240). 2 (H) Title 23, United States Code. 3 (I) Subtitle IV of Title 40, United States 4 Code. 5 (J) Sections 116, 117, 330, and 5505 and 6 chapters 53, 303, 311, 313, 701, and 702 of 7 title 49, United States Code. 8 (2) HIGHWAY ACCOUNT.—The term ‘‘Highway 9 Account’’ means the portion of the Highway Trust 10 Fund that is not the Mass Transit Account. 11 (3) MASS TRANSIT ACCOUNT.—The term ‘‘Mass 12 Transit Account’’ means the portion of the Highway 13 Trust Fund established under section 9503(e)(1) of 14 the Internal Revenue Code of 1986. 15 SEC. 1002. EXTENSION OF HIGHWAY-RELATED TAXES. 1 (a) IN GENERAL.— 2 (1) Each of the following provisions of the In- 3 ternal Revenue Code of 1986 is amended by striking 4 ‘‘September 30, 2022’’ and inserting ‘‘September 5 30, 2025’’: 6 (A) Section 4041(a)(1)(C)(iii)(I). 7 (B) Section 4041(m)(1)(B). 8 (C) Section 4081(d)(1). 9 (2) Each of the following provisions of such 10 Code is amended by striking ‘‘October 1, 2022’’ and 11 inserting ‘‘October 1, 2025’’: 12 (A) Section 4041(m)(1)(A). 13 (B) Section 4051(c). 14 (C) Section 4071(d). 15 (D) Section 4081(d)(3). 16 (b) EXTENSION OF TAX, ETC., ON USE OF CERTAIN 17 HEAVY VEHICLES.—Each of the following provisions of 18 the Internal Revenue Code of 1986 is amended by striking 19 ‘‘2023’’ each place it appears and inserting ‘‘2025’’: 20 (1) Section 4481(f). 21 (2) Subsections (c)(4) and (d) of section 4482. 22 (c) FLOOR STOCKS REFUNDS.—Section 6412(a)(1) 23 of the Internal Revenue Code of 1986 is amended— 24 (1) by striking ‘‘October 1, 2022’’ each place it 25 appears and inserting ‘‘October 1, 2025’’; 26 VerDate Sep 11 2014 22:38 Aug 06, 2020 Jkt 099200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H7248.IH H7248 pbinns on DSKJLVW7X2PROD with BILLS 9 •HR 7248 IH (2) by striking ‘‘March 31, 2023’’ each place it 1 appears and inserting ‘‘March 31, 2025’’; and 2 (3) by striking ‘‘January 1, 2023’’ and insert- 3 ing ‘‘January 1, 2025’’. 4 (d) EXTENSION OF CERTAIN EXEMPTIONS.— 5 (1) Section 4221(a) of the Internal Revenue 6 Code of 1986 is amended by striking ‘‘October 1, 7 2022’’ and inserting ‘‘October 1, 2025’’. 8 (2) Section 4483(i) of such Code is amended by 9 striking ‘‘October 1, 2023’’ and inserting ‘‘October 10 1, 2025’’. 11 (e) EXTENSION OF TRANSFERS OF CERTAIN 12 TAXES.— 13 (1) IN GENERAL.—Section 9503 of the Internal 14 Revenue Code of 1986 is amended— 15 (A) in subsection (b)— 16 (i) by striking ‘‘October 1, 2022’’ 17 each place it appears in paragraphs (1) 18 and (2) and inserting ‘‘October 1, 2025’’; 19 (ii) by striking ‘‘OCTOBER 1, 2022’’ in 20 the heading of paragraph (2) and inserting 21 ‘‘OCTOBER 1, 2025’’; 22 (iii) by striking ‘‘September 30, 23 2022’’ in paragraph (2) and inserting 24 ‘‘September 30, 2025’’; and 25 VerDate Sep 11 2014 22:38 Aug 06, 2020 Jkt 099200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H7248.IH H7248 pbinns on DSKJLVW7X2PROD with BILLS 10 •HR 7248 IH (iv) by striking ‘‘July 1, 2023’’ in 1 paragraph (2) and inserting ‘‘July 1, 2 2025’’; and 3 (B) in subsection (c)(2), by striking ‘‘July 4 1, 2023’’ and inserting ‘‘July 1, 2025’’. 5 (2) MOTORBOAT AND SMALL-ENGINE FUEL TAX 6 TRANSFERS.— 7 (A) IN GENERAL.—Paragraphs (3)(A)(i) 8 and (4)(A) of section 9503(c) of such Code are 9 each amended by striking ‘‘October 1, 2022’’ 10 and inserting ‘‘October 1, 2025’’. 11 (B) CONFORMING AMENDMENTS TO LAND 12 AND WATER CONSERVATION FUND.—Section 13 200310 of title 54, United States Code, is 14 amended by striking ‘‘October 1, 2023’’ each 15 place it appears and inserting ‘‘October 1, 16 2025’’; and (ii) by striking ‘‘October 1, 2022’’ 17 and inserting ‘‘October 1, 2025.’’ 18 (f) EFFECTIVE DATE.—The amendments made by 19 this section shall take effect on October 1, 2020. 20 SEC. 1004.
