ical treatment facilities, and for other purposes.

to the Committee on Armed Services
A BILL
To amend title 31, United States Code, to address claims
of the United States Government relating to care re-
ceived by civilians at military medical treatment facilities,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Financial Relief for
4
Civilians Treated at Military Hospitals Act’’.

SEC. 2. DEBT ARISING FROM TREATMENT AT MILITARY

MEDICAL TREATMENT FACILITIES.
2
Section 3711 of title 31, United States Code, is
3
amended—
4
(1) in subsection (g)(2)—
5
(A) in subparagraph (A)(v), by striking
6
‘‘and’’ at the end;
7
(B) in subparagraph (B), by striking the
8
period at the end and inserting ‘‘; and’’; and
9
(C) by adding at the end the following:
10
‘‘(C) to any debt or claim described in sub-
11
section (j).’’; and
12
(2) by adding at the end the following:
13
‘‘(j) The Secretary of Defense may not take an action
14
under subsection (a), and shall suspend or terminate an
15
action by the Secretary of a military department under
16
that subsection, to collect a claim arising from care pro-
17
vided at a military medical treatment facility to a civilian
18
who is not a covered beneficiary (as that term is defined
19
in section 1072 of title 10).’’.

amended—

(1) by redesignating subsection (b) as sub-

section (c); and
2
(2) by inserting after subsection (a) the fol-
3
lowing new subsection (b):

‘‘(b) LIMITATION ON FEES FOR CERTAIN TREAT-
5
MENT.—(1) Under the procedures developed under sub-
6
section (a), a military medical treatment facility may not
7
charge a civilian who is not a covered beneficiary any fee
8
for covered treatment provided to the civilian at the facil-
9
ity.

‘‘(2) In this subsection, the term ‘covered treatment’,
11
with respect to treatment provided to a civilian at a mili-
12
tary medical treatment facility, means emergency medical
13
treatment that can be provided only at the military med-
14
ical treatment facility due to the severity of the condition
15
of the civilian and the location of the civilian.’’.
