To amend the Small Business Act to include hospitals serv-
ing rural areas or areas of persistent poverty in the
paycheck protection program, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘PPP Access for Rural
4
Hospitals Act’’.

SEC. 2. INCLUSION OF CRITICAL CARE HOSPITALS IN THE

PAYCHECK PROTECTION PROGRAM.

(a) ELIGIBILITY OF HOSPITALS WITH MORE THAN
3
ONE PHYSICAL LOCATION.—Section 7(a)(36)(D)(iii) of
4
the Small Business Act (15 U.S.C. 636(a)(36)(D)(iii)) is
5
amended by striking ‘‘beginning with 72’’ and inserting
6
the following: ‘‘beginning with 72 (or, in the case of a crit-
7
ical care hospital, is assigned a North American Industry
8
Classification System code beginning with 62)’’.

(b) WAIVER
OF
AFFILIATION
RULES.—Section
10
7(a)(36)(D)(iv)(I) of the Small Business Act (15 U.S.C.
11
636(a)(36)(D)(iv)(I)) is amended by striking ‘‘beginning
12
with 72’’ and inserting the following: ‘‘beginning with 72
13
(or, in the case of a critical care hospital, is assigned a
14
North American Industry Classification System code be-
15
ginning with 62)’’.

(c) CRITICAL CARE HOSPITALS DEFINED.—Section
17
7(a)(36)(D) of the Small Business Act (15 U.S.C.
18
636(a)(36)(D)) is amended by adding at the end the fol-
19
lowing new clause:
20
‘‘(vii) CRITICAL CARE HOSPITAL DE-
21
FINED.—In this clause, the term ‘critical
22
care hospital’ means a hospital (as defined
23
in section 1861(e) of the Social Security
24
Act (42 U.S.C. 1395x(e))) that—

‘‘(I) is located in a county (or

equivalent unit of local government)

in a rural area, as defined in section

1886(d)(2)(D) of the Social Security
4
Act (42 U.S.C. 1395ww(d)(2)(D)), is
5
treated as being located in a rural
6
area
pursuant
to
section
7
1886(d)(8)(E) of such Act (42 U.S.C.
8
1395ww(d)(8)(E)), or is a critical ac-
9
cess hospital, as defined in section
10
1861(mm)(1) of such Act (42 U.S.C.
11
1395x(mm)(1)); or
12
‘‘(II) for the most recent cost re-
13
porting period under section 1886(d)
14
of the Social Security Act (42 U.S.C.
15
1395ww(d)), received an additional
16
payment under section 1886(d)(5)(F)
17
of
such
Act
(42
U.S.C.
18
1395ww(d)(5)(F)).’’.
