Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Confederate Monu- 4 ment Removal Act’’. 5 SEC. 2. REQUIREMENTS AND REMOVAL PROCEDURES. 6 (a) REQUIREMENTS.—Section 1814 of the Revised 7 Statutes (2 U.S.C. 2131) is amended by inserting ‘‘(other 8 VerDate Sep 11 2014 23:53 Jun 25, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S3957.IS S3957 pbinns on DSKJLVW7X2PROD with BILLS 2 •S 3957 IS than persons who served voluntarily with the Confederate 1 States of America)’’ after ‘‘military services’’. 2 (b) STATUE REMOVAL PROCEDURES.— 3 (1) IN GENERAL.—The Architect of the Capitol 4 shall— 5 (A) identify all statues on display in the 6 Capitol of the United States that do not meet 7 the requirements of section 1814 of the Revised 8 Statutes (2 U.S.C. 2131), as amended by sub- 9 section (a); and 10 (B) subject to the approval of the Joint 11 Committee on the Library of Congress, arrange 12 for the removal of each such statue from the 13 Capitol by not later than 120 days after the 14 date of enactment of this Act. 15 (2) REMOVAL AND RETURN OF STATUES.— 16 (A) IN GENERAL.—Subject to subpara- 17 graph (C), the Architect of the Capitol shall ar- 18 range to transfer and deliver any statue that is 19 removed under this subsection to the Smithso- 20 nian Institution. 21 (B) STORAGE OR DISPLAY OF STATUES.— 22 The Board of Regents of the Smithsonian Insti- 23 tution shall follow the policies and procedures 24 of the Smithsonian Institution, as in effect on 25 VerDate Sep 11 2014 23:53 Jun 25, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S3957.IS S3957 pbinns on DSKJLVW7X2PROD with BILLS 3 •S 3957 IS the day before the date of enactment of this 1 Act, regarding the storage and display of any 2 statue transferred under subparagraph (A). 3 (C) STATE REQUESTS.—A statue provided 4 for display by a State that is removed under 5 this subsection shall be returned to the State, 6 and the ownership of the statue transferred to 7 the State, if the State so requests and agrees 8 to pay any costs related to the transportation of 9 the statue to the State. 10 (3) REPLACEMENT OF STATUES.—A State that 11 has a statue removed under this subsection shall be 12 able to replace such statue in accordance with the 13 requirements and procedures of section 1814 of the 14 Revised Statutes (2 U.S.C. 2131) and section 311 of 15 the Legislative Branch Appropriations Act, 2001 (2 16 U.S.C. 2132). 17 (4) AUTHORIZATION AND APPROPRIATIONS.— 18 (A) IN GENERAL.—There are appropriated 19 for the fiscal year ending September 30, 2020, 20 out of any money in the Treasury not otherwise 21 appropriated, $5,000,000 to carry out this sec- 22 tion, including the costs related to the removal, 23 transfer, security, storage, and display of the 24 VerDate Sep 11 2014 23:53 Jun 25, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S3957.IS S3957 pbinns on DSKJLVW7X2PROD with BILLS 4 •S 3957 IS statues described in paragraph (1)(A), of 1 which— 2 (i) $2,000,000 shall be made available 3 to the Architect of the Capitol; and 4 (ii) $3,000,000 shall be made avail- 5 able to the Smithsonian Institution. 6 (B) AVAILABILITY.—Amounts appro- 7 priated under subparagraph (A) shall remain 8 available until expended. 9 Æ VerDate Sep 11 2014 23:53 Jun 25, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S3957.IS S3957 pbinns on DSKJLVW7X2PROD with BILLS
