PROHIBITION ON BURIAL IN ARLINGTON NA- 1 TIONAL CEMETERY, VIRGINIA, OF ANY PRESI- 2 DENT OR VICE PRESIDENT WHO IS NOT A 3 MEMBER OR VETERAN OF THE ARMED 4 FORCES. 5 Section 7722(a) of title 10, United States Code, is 6 amended by adding at the end the following new para- 7 graph: 8 ‘‘(3)(A) In carrying out paragraphs (1) and (2), the 9 Secretary of Defense shall not approve a determination of 10 eligibility for interment or inurnment in Arlington Na- 11 tional Cemetery made by the Secretary of the Army that 12 permits the interment or inurnment in Arlington National 13 Cemetery of an individual who is not a member of the 14 armed forces or a veteran (as that term is defined in sec- 15 tion 101(2) of title 38), but served as President of the 16 United States or Vice President of the United States. 17 ‘‘(B) For purposes of subparagraph (A), a President 18 shall not be considered a member of the armed forces or 19 a veteran by virtue of service under the Constitution as 20 the Commander-in-Chief, and a Vice President shall not 21 be considered a member of the armed forces or a veteran 22 by virtue of service under the Constitution as Vice Presi- 23 dent.’’. 24 Æ VerDate Sep 11 2014 04:02 Jun 25, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\S3935.IS S3935 kjohnson on DSK79L0C42PROD with BILLS
