A BILL
To amend the Motor Carrier Safety Improvement Act of
1999 with respect to exemptions from certain motor car-
rier regulations, to direct the Secretary of Transportation
to issue regulations related to agricultural commodities,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Fixing America’s Reg-
4
ulatory Mess To Facilitate Agricultural Byproducts and
5
Livestock Expedited Delivery Act’’ or the ‘‘FARM to
6
TABLE Delivery Act’’.

SEC. 2. TRANSPORTATION OF AGRICULTURAL COMMOD-

ITIES AND FARM SUPPLIES.

Section 229 of the Motor Carrier Safety Improve-
3
ment Act of 1999 (49 U.S.C. 31136 note) is amended—
4
(1) in subsection (a)(1) by striking ‘‘during
5
planting and harvest periods, as determined by each
6
State,’’; and
7
(2) in subsection (e)(8) by striking ‘‘during the
8
planting and harvesting seasons within each State,
9
as determined by the State, and livestock feed at
10
any time of the year’’ and inserting ‘‘and livestock
11
feed’’.

SEC. 3. DEFINITION OF AGRICULTURAL COMMODITY.

(a) IN GENERAL.—Not later than 180 days after the
14
date of enactment of this Act, the Secretary of Transpor-
15
tation shall issue such regulations as are necessary to
16
amend the definition of agricultural commodity consistent
17
with this section.

(b) DEFINITION OF AGRICULTURAL COMMODITY.—
19
In this section, the term ‘‘agricultural commodity’’
20
means—
21
(1) any product planted or harvested for food,
22
feed, fuel, or fiber;
23
(2) any non-human living animals (including
24
fish, insets, and livestock as defined in section 602
25
of the Emergency Livestock Feed Assistance Act of

1988 (7 U.S.C. 1471)) and the products thereof, in-

cluding milk, eggs, and honey;
2
(3) agricultural aquacultural, forestry, horti-
3
cultural, and floricultural commodities;
4
(4) fruits and vegetables;
5
(5) other agricultural products that are sen-
6
sitive to temperature and climate and at the risk of
7
perishing in transit;
8
(6) animal feed (including ingredients of such
9
feed);
10
(7) products used during harvest and packaging
11
prior to processing, including bins, boxes, jars, and
12
cans; and
13
(8) products of preservation.
