Mr. BRADY (for himself, Mr. KELLY of Pennsylvania, Mr. LAHOOD, Mr. FER-
GUSON, Mr. WENSTRUP, and Mr. SCHWEIKERT) introduced the following
bill; which was referred to the Committee on Oversight and Reform
A BILL
To require States to certify a process for distributing
Coronavirus Relief Funds to local governments.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. STATE DISTRIBUTION OF CORONAVIRUS RE-
3
LIEF FUND.

(a) IN GENERAL.—Not later than June 12, 2020,
5
each State that received a payment for fiscal year 2020
6
under section 601(b)(1) of the Social Security Act (42
7
U.S.C. 801(b)(1)) shall provide the Secretary of the
8
Treasury with a certification signed by the Chief Execu-
9
tive for the State that—

(1) certifies that the State has in effect a proce-
1
dure to distribute funds provided under such pay-
2
ment, to the extent determined appropriate by the
3
State, to units of local government within the State;
4
and
5
(2) includes a detailed description of such pro-
6
cedure.

(b) RECOUPMENT.—If the Inspector General of the
8
Department of the Treasury determines, pursuant to the
9
authority provided under section 601(f) of such Act (42
10
U.S.C. 801(f)), that a State has failed to comply with sub-
11
section (a) with respect to a payment described in such
12
subsection, an amount equal to 25 percent of such pay-
13
ment shall be booked as a debt of such entity owed to
14
the Federal Government. Amounts recovered under this
15
subsection shall be deposited into the general fund of the
16
Treasury.
