A BILL
To direct the Secretary of Veterans Affairs to increase the
supply of prescription drugs for which the Secretary pays
for veterans during a public health emergency.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Veterans Prescription
4
Flexibility Act’’.

SEC. 2. PAYMENT BY DEPARTMENT OF VETERANS AFFAIRS

OF PRESCRIPTION DRUGS FOR VETERANS

DURING PUBLIC HEALTH EMERGENCY.

(a) INCREASE OF SUPPLY OF PRESCRIPTIONS.—Dur-
4
ing a public health emergency, the Secretary of Veterans
5
Affairs shall pay for prescriptions for up to a 90-day sup-
6
ply of drugs, including over-the-counter drugs and medical
7
and surgical supplies, written by an eligible health care
8
provider, notwithstanding section 17.4025(b)(1) of title
9
38, Code of Federal Regulations, or such successor regula-
10
tion.

(b) DEFINITIONS.—In this section:

(1) The term ‘‘eligible health care provider’’
13
means a health care provider under section 1703(c)
14
of title 38, United States Code, or an eligible entity
15
or provider under section 1703A(b) of such title.

(2) The term ‘‘public health emergency’’ means
17
a public health emergency declared by the Secretary
18
of Health and Human Services under section 319 of
19
the Public Health Service Act (42 U.S.C. 247d).
