Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘National Guard
4
COVID–19 Earned Benefits Guarantee Act’’.

SEC. 2. TREATMENT OF A PERIOD OF FULL-TIME NATIONAL
6
GUARD DUTY, PERFORMED IN RESPONSE TO
7
THE COVID–19 NATIONAL EMERGENCY, AS
8
NOT SHORTER THAN 90 DAYS.

(a) IN GENERAL.—The Secretaries of Defense and
10
Veterans Affairs shall treat a period of covered duty as
11
a period not shorter than 90 days.

(b) DEFINITIONS.—In this Act:
13
(1) The term ‘‘covered duty’’ means full-time
14
National Guard duty performed—
15
(A) by an individual other than a member
16
of Congress; and
17
(B) in response to the covered national
18
emergency.

(2) The term ‘‘covered national emergency’’
20
means the national emergency declared on March
21
13, 2020, by the President under the National
22
Emergencies Act (50 U.S.C. 1601 et seq.) with re-
23
spect to COVID–19.
