FINDINGS. 1 Congress finds the following: 2 (1) Since the onset of airborne naval military 3 training in Nevada as early as 1944, residents of the 4 Silver State have coped with the direct and indirect 5 effects of training overflights. 6 VerDate Sep 11 2014 22:37 Jun 08, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H6889.IH H6889 pbinns on DSKJLVW7X2PROD with BILLS 6 •HR 6889 IH (2) Such effects are heard, seen, and felt most 1 acutely near the bases and bombing ranges dedi- 2 cated to furthering the United States military’s mis- 3 sion interests, but extend more than 100 miles be- 4 yond, for example, Naval Air Station Fallon. 5 (3) Additionally, Nevadans who live and work 6 beneath dedicated air training routes throughout 7 central, north-central, and northwestern Nevada live 8 with persistent noise and periodic disruptions related 9 to training activities day and night. 10 (4) Although direct impacts of military training 11 are centered in Churchill County to the north, east, 12 and south of Fallon, adjoining counties also com- 13 monly endure both high- and low-level overflights. 14 Pershing, Lander Nye, Mineral, Washoe, and Lyon 15 counties shoulder much of this burden. 16 (5) Providing for the common sense rationaliza- 17 tion of the 19th century checkerboard land-owner- 18 ship and public interest conveyances of land, for ex- 19 ample, for fire stations, airports, and municipal 20 parks, represents reasonable mitigation for ongoing 21 impacts to Nevada’s communities. 22 (6) The Fallon Range Training Complex and 23 Naval Air Station Fallon’s economic, environmental, 24 and community impacts are seen throughout all of 25 VerDate Sep 11 2014 22:37 Jun 08, 2020 Jkt 099200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H6889.IH H6889 pbinns on DSKJLVW7X2PROD with BILLS 7 •HR 6889 IH northern Nevada and are not limited to just the 1 Fallon Range Training Complex’s geographic foot- 2 print. 3 (7) On April 15, 2020, the Churchill County 4 Board of Commissioners passed a resolution sup- 5 porting legislation to address and mitigate the 6 Navy’s Record of Decision through the National De- 7 fense Authorization Act for Fiscal Year 2021, as 8 well as allow for conveyances for economic develop- 9 ment and public purposes in Churchill County, as 10 depicted by the County’s updated map entitled 11 ‘‘Churchill County Proposed Fallon Range Training 12 Complex Modernization and Lands Bill’’ and dated 13 March 18, 2020, as identified in division A of this 14 Act. 15 (8) On April 5, 2018, the Douglas County 16 Board of Commissioners requested that the Nevada 17 congressional delegation reintroduce the Douglas 18 County Economic Development and Conservation 19 Act, included as title I of division B of this Act. 20 (9) On October 10, 2019, the Lander County 21 Board of Commissioners passed a resolution express- 22 ing support for the introduction of legislation pro- 23 moting certain public safety, public welfare, public 24 VerDate Sep 11 2014 22:37 Jun 08, 2020 Jkt 099200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H6889.IH H6889 pbinns on DSKJLVW7X2PROD with BILLS 8 •HR 6889 IH parks, and tourism opportunities, included as title 1 IV of division B of this Act. 2 (10) On November 15, 2018, the Carson City 3 Board of Supervisors passed a resolution expressing 4 support for the introduction of legislation containing 5 certain conveyances and technical corrections, in- 6 cluded as title VI of division B of this Act. 7 (11) On December 9, 2019, the Pershing Coun- 8 ty Board of Commissioners requested that the Ne- 9 vada congressional delegation support the Pershing 10 County Economic Development and Conservation 11 Act, included as title VII of division B of this Act. 12 (12) On November 13, 2019, the White Pine 13 County Board of Commissioners passed a resolution 14 requesting reintroduction of the technical corrections 15 provided for in the White Pine County Conservation, 16 Recreation, and Development Act, included as title 17 XI of division B of this Act. 18 VerDate Sep 11 2014 22:37 Jun 08, 2020 Jkt 099200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H6889.IH H6889 pbinns on DSKJLVW7X2PROD with BILLS 9 •HR 6889 IH DIVISION A—FALLON RANGE 1 TRAINING COMPLEX LAND 2 WITHDRAWAL AND RELATED 3 MATTERS 4 TITLE I—FALLON RANGE 5 TRAINING COMPLEX, NEVADA 6 SEC. 101. SHORT TITLE. 7 This title may be cited as the ‘‘Fallon Range Training 8 Complex Land Withdrawal Act of 2020’’. 9 SEC. 102. DEFINITIONS. 10 In this title: 11 (1) COUNTY.—The term ‘‘county’’ means 12 Churchill County, Nevada. 13 (2) MAP.—The term ‘‘map’’ means the map en- 14 titled ‘‘Churchill County Proposed Fallon Range 15 Training Complex Modernization and Lands Bill’’ 16 and dated March 18, 2020. 17 SEC. 103. WITHDRAWAL AND RESERVATION FOR FALLON 18 RANGE TRAINING COMPLEX. 19 (a) WITHDRAWAL.— 20 (1) B–16, B–17, B–19, AND B–20 RANGES.—The 21 lands established as the B–16, B–17, B–19, and B– 22 20 ranges at the Fallon Range Training Complex, as 23 depicted on the map, which may become subject to 24 the operation of the public land laws, are hereby 25 VerDate Sep 11 2014 22:37 Jun 08, 2020 Jkt 099200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H6889.IH H6889 pbinns on DSKJLVW7X2PROD with BILLS 10 •HR 6889 IH withdrawn from all forms of appropriation under the 1 public land laws, including the mining laws, the Fed- 2 eral Land Policy and Management Act of 1976 (43 3 U.S.C. 1701 et seq.), and the mineral leasing and 4 geothermal leasing laws. 5 (2) DIXIE VALLEY SPECIAL MANAGEMENT 6 AREA.—The lands established at the Dixie Valley 7 Special Management Area at the Fallon Range 8 Training Complex, as depicted on the map, which 9 may become subject to the operation of the public 10 land laws, are hereby withdrawn from mining laws, 11 but not all other forms of appropriation under the 12 public land laws, including the Federal Land Policy 13 and Management Act of 1976 (43 U.S.C. 1701 et 14 seq.), geothermal leasing laws, or the Taylor Grazing 15 Act. 16 (3) EXISTING RIGHTS AND CONDITIONS.—The 17 withdrawal of lands by this subsection is subject to 18 valid existing rights and subject to the other provi- 19 sions of this title. 20 (b) RESERVATION.— 21 (1) B–16, B–17, B–19, AND B–20 RANGES.—The 22 lands withdrawn by subsection (a)(1) are reserved 23 for use by the Secretary of the Navy for testing and 24 VerDate Sep 11 2014 22:37 Jun 08, 2020 Jkt 099200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\H6889.IH H6889 pbinns on DSKJLVW7X2PROD with BILLS 11 •HR 6889 IH training for aerial bombing, missile firing, and tac- 1 tical maneuvering and air support. 2 (2) DIXIE VALLEY SPECIAL MANAGEMENT 3 AREA.—The lands withdrawn by subsection (a)(2) 4 are available for use by the Secretary of the Navy 5 in a manner consistent [Text truncated for display.
