in addition to the Committee on Ways and Means, for a period to be sub-

such provisions as fall within the jurisdiction of the committee concerned
A BILL
To amend title XVIII of the Social Security Act to expand
the availability of medical nutrition therapy services
under the Medicare program.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Medical Nutrition
4
Therapy Act of 2020’’.

SEC. 2. EXPANDING THE AVAILABILITY OF MEDICAL NU-
1
TRITION THERAPY SERVICES UNDER THE
2
MEDICARE PROGRAM.
3
(a) IN GENERAL.—Section 1861 of the Social Secu-
4
rity Act (42 U.S.C. 1395x) is amended—
5
(1) in subsection (s)(2)(V), by striking ‘‘in the
6
case of’’ and all that follows through ‘‘organiza-
7
tions’’; and
8
(2) in subsection (vv)—
9
(A) in paragraph (1)—
10
(i) by striking ‘‘disease management’’
11
and inserting ‘‘the prevention, manage-
12
ment, or treatment of a disease or condi-
13
tion specified in paragraph (4)’’;
14
(ii) by inserting ‘‘or by a physician as-
15
sistant, nurse practitioner, or clinical nurse
16
specialist (as such terms are defined in
17
subsection (aa)(5)), or, in the case of such
18
services furnished to manage such a dis-
19
ease or condition that is an eating dis-
20
order, by a clinical psychologist (as defined
21
by the Secretary)’’ before the period at the
22
end; and
23
(iii) by adding at the end the fol-
24
lowing new sentence: ‘‘Such term shall not
25
include any such services furnished to an

individual for the prevention, management,
1
or treatment of a renal disease if such in-
2
dividual is receiving maintenance dialysis
3
for which payment is made under section
4
1881.’’; and
5
(B) by adding at the end the following new
6
paragraph:

‘‘(4) For purposes of paragraph (1), the diseases and
8
conditions specified in this paragraph are the following:
9
‘‘(A) Diabetes and prediabetes.
10
‘‘(B) A renal disease.
11
‘‘(C) Obesity (as defined for purposes of sub-
12
section (yy)(2)(C) or as otherwise defined by the
13
Secretary).
14
‘‘(D) Hypertension.
15
‘‘(E) Dyslipidemia.
16
‘‘(F) Malnutrition.
17
‘‘(G) Eating disorders.
18
‘‘(H) Cancer.
19
‘‘(I) Celiac disease.
20
‘‘(J) HIV.
21
‘‘(K) AIDS.
22
‘‘(L) Any other disease or condition—
23
‘‘(i) specified by the Secretary relating to
24
unintentional weight loss;

‘‘(ii) for which the Secretary determines
1
the services described in paragraph (1) to be
2
medically necessary and appropriate for the
3
prevention, management, or treatment of such
4
disease or condition, consistent with any appli-
5
cable recommendations of the United States
6
Preventive Services Task Force; or
7
‘‘(iii) for which the Secretary determines
8
the services described in paragraph (1) are
9
medically necessary, consistent with either pro-
10
tocols established by registered dietitians or nu-
11
trition professional organizations or with ac-
12
cepted clinical guidelines identified by the Sec-
13
retary.’’.

(b) EXCLUSION MODIFICATION.—Section 1862(a)(1)
15
is amended—
16
(1) in subparagraph (O), by striking ‘‘and’’ at
17
the end;
18
(2) in subparagraph (P), by striking the semi-
19
colon at the end and inserting ‘‘, and’’; and
20
(3) by adding at the end the following new sub-
21
paragraph:
22
‘‘(Q) in the case of medical nutrition therapy
23
services (as defined in section 1861(vv)), which are
24
not furnished for the prevention, management, or

(c) EFFECTIVE DATE.—The amendments made by
3
this section shall apply with respect to items and services
4
furnished on or after January 1, 2021.
