Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. PROHIBITING PAYMENT OF PANDEMIC UNEMPLOY- 1 MENT ASSISTANCE AND FEDERAL PANDEMIC 2 UNEMPLOYMENT COMPENSATION TO MIL- 3 LIONAIRES. 4 (a) PANDEMIC UNEMPLOYMENT ASSISTANCE.—Sec- 5 tion 2102 of the Relief for Workers Affected by 6 Coronavirus Act (contained in subtitle A of title II of divi- 7 sion A of the CARES Act (Public Law 116–136)) is 8 amended— 9 (1) in subsection (a)(3)(B)— 10 (A) in clause (i), by striking ‘‘or’’ at the 11 end; 12 (B) in clause (ii), by striking the period at 13 the end and inserting ‘‘; or’’; and 14 (C) by adding at the end the following new 15 clause: 16 ‘‘(iii) an individual whose adjusted 17 gross income is equal to or greater than 18 $1,000,000.’’; and 19 (2) by adding at the end the following new sub- 20 section: 21 ‘‘(i) PROHIBITION ON ASSISTANCE TO MILLION- 22 AIRES.— 23 ‘‘(1) COMPLIANCE.—Any application for assist- 24 ance authorized under subsection (b) shall include a 25 form or procedure for an individual applicant to cer- 26 VerDate Sep 11 2014 23:13 Jun 11, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S3777.IS S3777 kjohnson on DSK79L0C42PROD with BILLS 3 •S 3777 IS tify that such individual is not prohibited from re- 1 ceiving such assistance pursuant to subsection 2 (a)(3)(B)(iii). 3 ‘‘(2) AUDITS.—The certifications required by 4 paragraph (1) shall be auditable by the Department 5 of Labor or the Government Accountability Office.’’. 6 (b) FEDERAL PANDEMIC UNEMPLOYMENT COM- 7 PENSATION.—Section 2104(b) of the Relief for Workers 8 Affected by Coronavirus Act (contained in subtitle A of 9 title II of division A of the CARES Act (Public Law 116– 10 136)) is amended by adding at the end the following new 11 paragraph: 12 ‘‘(3) PROHIBITION ON COMPENSATION TO MIL- 13 LIONAIRES.— 14 ‘‘(A) IN GENERAL.—Federal Pandemic 15 Unemployment Compensation shall not be pay- 16 able to any individual whose adjusted gross in- 17 come is equal to or greater than $1,000,000. 18 ‘‘(B) COMPLIANCE.—Any application for 19 regular compensation shall include a form or 20 procedure for an individual applicant to certify 21 that such individual is not prohibited from re- 22 ceiving Federal Pandemic Unemployment Com- 23 pensation pursuant to subparagraph (A). 24 VerDate Sep 11 2014 23:13 Jun 11, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S3777.IS S3777 kjohnson on DSK79L0C42PROD with BILLS 4 •S 3777 IS ‘‘(C) AUDITS.—The certifications required 1 by subparagraph (B) shall be auditable by the 2 Department of Labor or the Government Ac- 3 countability Office.’’. 4 (c) RULE OF CONSTRUCTION.—Nothing in this Act, 5 or any amendment made by this Act, may be construed 6 to apply to regular compensation or extended compensa- 7 tion (as such terms are defined by section 205 of the Fed- 8 eral-State Extended Unemployment Compensation Act 9 (26 U.S.C. 3304 note)) to which an individual may be oth- 10 erwise entitled. 11 (d) EFFECTIVE DATE.—The amendments made by 12 this section shall apply to weeks of unemployment begin- 13 ning on or after the date of the enactment of this Act. 14 Æ VerDate Sep 11 2014 23:13 Jun 11, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S3777.IS S3777 kjohnson on DSK79L0C42PROD with BILLS
