distributes a mobile application that is owned, wholly or partially, by
the Chinese Communist Party or by a non-state owned entity located
in China, to disclose that fact to any individual who downloads or

A BILL
To require any person that maintains an internet website
or that sells or distributes a mobile application that
is owned, wholly or partially, by the Chinese Communist
Party or by a non-state owned entity located in China,
to disclose that fact to any individual who downloads
or otherwise uses such application.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Internet Application
4
Integrity and Disclosure Act’’ or the ‘‘Internet Application
5
I.D. Act’’.

SEC. 2. CHINESE OWNERSHIP DISCLOSURE REQUIRE-

MENTS.

(a) IN GENERAL.—

(1) DISCLOSURE.—Any person that maintains
4
an internet website or that sells or distributes a mo-
5
bile application that is owned, wholly or partially, by
6
the Chinese Communist Party or by a non-state
7
owned entity located in China, shall disclose to any
8
individual who downloads or otherwise uses such ap-
9
plication, in a clear and conspicuous manner, that
10
such website or mobile application is owned, wholly
11
or partially, by the Chinese Communist Party or by
12
a non-state owned entity located in China.

(2) FALSE INFORMATION.—It shall be unlawful
14
for any person to knowingly provide false informa-
15
tion with respect to the information required under
16
this subsection.

SEC. 3. ENFORCEMENT.

(a) UNFAIR AND DECEPTIVE ACTS OR PRACTICES.—
19
(1) A violation of this Act shall be treated as
20
a violation of a rule defining an unfair or deceptive
21
act or practice prescribed under section 18(a)(1)(B)
22
of the Federal Trade Commission Act (15 U.S.C.
23
57a(a)(1)(B)).

(1) IN GENERAL.—The Federal Trade Commis-

sion shall enforce this Act in the same manner, by
2
the same means, and with the same jurisdiction,
3
powers, and duties as though all applicable terms
4
and provisions of the Federal Trade Commission Act
5
(15 U.S.C. 41 et seq.) were incorporated into and
6
made a part of this Act.

(2) PRIVILEGES AND IMMUNITIES.—Any person
8
that violates this Act shall be subject to the pen-
9
alties (including the provisions of subsections (l) and
10
(m) of section 5 of such Act which provide for a
11
maximum civil penalty per violation of $42,350 (as
12
of February 14, 2019)), and entitled to the privi-
13
leges and immunities, provided in the Federal Trade
14
Commission Act (15 U.S.C. 41 et seq.).
