BOOKER) introduced the following bill; which was read twice and referred
to the Committee on Banking, Housing, and Urban Affairs
A BILL
To amend the CARES Act to provide the Special Inspector
General for Pandemic Recovery with additional personnel
authorities, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Special Inspector Gen-
4
eral for Pandemic Recovery Expedited Hiring Authorities
5
Act of 2020’’.

SEC. 2. SPECIAL INSPECTOR GENERAL FOR PANDEMIC RE-

COVERY.

Section 4018(e) of the CARES Act (Public Law 116–
3
136) is amended—
4
(1) in paragraph (1)—
5
(A) by striking ‘‘The Special’’ and insert-
6
ing the following:
7
‘‘(A) IN
GENERAL.—Subject to subpara-
8
graph (B), the Special’’; and
9
(B) by adding at the end the following:
10
‘‘(B) ADDITIONAL AUTHORITIES.—
11
‘‘(i) IN GENERAL.—Subject to clause
12
(ii), the Special Inspector General may ex-
13
ercise any authority provided to the head
14
of a temporary organization under section
15
3161 of title 5, United States Code, with-
16
out regard to whether the Office of the
17
Special Inspector General for Pandemic
18
Recovery qualifies as a temporary organi-
19
zation under subsection (a) of that section.
20
‘‘(ii) LIMITATIONS.—With respect to
21
the exercise of authority under subsection
22
(b) of section 3161 of title 5, United
23
States Code, as permitted under clause (i)
24
of this subparagraph—

‘‘(I) the Special Inspector Gen-

eral may not make any appointment
2
under that subsection on or after the
3
later of—
4
‘‘(aa) the date that is 180
5
days after the date of enactment
6
of the Special Inspector General
7
for Pandemic Recovery Expedited
8
Hiring Authorities Act of 2020;
9
or
10
‘‘(bb) the date that is 180
11
days after the date on which the
12
Special Inspector General is con-
13
firmed by the Senate;
14
‘‘(II) paragraph (2) of that sub-
15
section (relating to periods of appoint-
16
ments) shall not apply; and
17
‘‘(III) no period of an appoint-
18
ment made under that subsection may
19
extend after the date on which the Of-
20
fice of the Special Inspector General
21
for Pandemic Recovery terminates
22
under subsection (h).’’; and
23
(2) by adding at the end the following:

‘‘(5) REEMPLOYMENT OF ANNUITANTS.—

‘‘(A) IN
GENERAL.—Subject to subpara-
1
graph (B), if an annuitant receiving an annuity
2
from the Civil Service Retirement and Dis-
3
ability Fund becomes employed in a position in
4
the Office of the Special Inspector General for
5
Pandemic Recovery—
6
‘‘(i) the annuity of that annuitant
7
shall continue; and
8
‘‘(ii) that reemployed annuitant shall
9
not be considered to be an employee for
10
the purposes of chapter 83 or 84 of title
11
5, United States Code.
12
‘‘(B)
LIMITATIONS.—Subparagraph
(A)
13
shall apply to—
14
‘‘(i) not more than 25 employees of
15
the Office of the Special Inspector General
16
for Pandemic Recovery at any particular
17
time, as designated by the Special Inspec-
18
tor General; and
19
‘‘(ii) pay periods beginning after the
20
date of enactment of the Special Inspector
21
General for Pandemic Recovery Expedited
22
Hiring Authorities Act of 2020.’’.
