AN ACT
To provide relief for the recipients of financial assistance
awards from the Federal Motor Carrier Safety Adminis-
tration, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
1
This Act may be cited as the ‘‘Motor Carrier Safety
2
Grant Relief Act of 2020’’.

SEC. 2. RELIEF FOR RECIPIENTS OF FINANCIAL ASSIST-
4
ANCE AWARDS FROM THE FEDERAL MOTOR
5
CARRIER SAFETY ADMINISTRATION.

(a) DEFINITION OF SECRETARY.—In this section, the
7
term ‘‘Secretary’’ means the Secretary of Transportation.
8
(b) RELIEF FOR RECIPIENTS OF FINANCIAL ASSIST-
9
ANCE AWARDED FOR FISCAL YEARS 2019 AND 2020.—
10
(1) PERIOD OF AVAILABILITY.—
11
(A) IN
GENERAL.—Notwithstanding any
12
provision of chapter 311 of title 49, United
13
States Code (including any applicable period of
14
availability under section 31104(f) of that title),
15
and any regulations promulgated under that
16
chapter and subject to subparagraph (B), the
17
period of availability during which a recipient
18
may expend amounts made available to the re-
19
cipient under a grant or cooperative agreement
20
described in clauses (i) through (v) shall be—
21
(i) for a grant made under section
22
31102 of that title (other than subsection
23
(l) of that section)—
24
(I) the fiscal year in which the
25
Secretary approves the financial as-

sistance agreement with respect to the

grant; and
2
(II) the following 2 fiscal years;
3
(ii) for a grant made or a cooperative
4
agreement entered into under section
5
31102(l)(2) of that title—
6
(I) the fiscal year in which the
7
Secretary approves the financial as-
8
sistance agreement with respect to the
9
grant or cooperative agreement; and
10
(II) the following 3 fiscal years;
11
(iii) for a grant made under section
12
31102(l)(3) of that title—
13
(I) the fiscal year in which the
14
Secretary approves the financial as-
15
sistance agreement with respect to the
16
grant; and
17
(II) the following 5 fiscal years;
18
(iv) for a grant made under section
19
31103 of that title—
20
(I) the fiscal year in which the
21
Secretary approves the financial as-
22
sistance agreement with respect to the
23
grant; and

(II) the following 2 fiscal years;

and
2
(v) for a grant made or a cooperative
3
agreement entered into under section
4
31313 of that title—

(I) the year in which the Sec-
6
retary approves the financial assist-
7
ance agreement with respect to the
8
grant or cooperative agreement; and
9
(II) the following 5 fiscal years.

(B) APPLICABILITY.—
11
(i) AMOUNTS AWARDED FOR FISCAL
12
YEARS
2019
AND
2020.—The periods of
13
availability described in subparagraph (A)
14
shall apply only—
15
(I) to amounts awarded for fiscal
16
year 2019 or 2020 under a grant or
17
cooperative agreement described in
18
clauses (i) through (v) of that sub-
19
paragraph; and
20
(II) for the purpose of expanding
21
the period of availability during which
22
the recipient may expend the amounts
23
described in subclause (I).

(ii) AMOUNTS AWARDED FOR OTHER
1
YEARS.—The periods of availability de-
2
scribed in subparagraph (A) shall not
3
apply to any amounts awarded under a
4
grant or cooperative agreement described
5
in clauses (i) through (v) of that subpara-
6
graph for any fiscal year other than fiscal
7
year 2019 or 2020, and those amounts
8
shall be subject to the period of availability
9
otherwise applicable to those amounts
10
under Federal law.

(2) REALLOCATION
OF
RELEASED
FUNDS.—
12
Notwithstanding any other provision of law, any
13
amounts released back to the Secretary under sec-
14
tion 31104(i) of title 49, United States Code, that
15
were made available to the Secretary under section
16
31104(a) of that title for fiscal year 2019 or 2020
17
shall not be subject to any limitation on obligations
18
under Federal law.
