A BILL
To amend title 23, United States Code, to modify the appor-
tionment formula for the congestion mitigation and air
quality improvement program, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ββCongestion Mitigation
4
and Air Quality Improvement Modernization Actββ.

SEC. 2. APPORTIONMENT.

Section 104(b)(4) of title 23, United States Code, is

amended to read as follows:

APPORTIONMENT.βNot-

withstanding any other provision of this para-

graph, the minimum apportionment for a State
10
under this paragraph shall be one half of 1 per-

cent of the funds apportioned under this para-

graph.

Section 149 of title 23, United States Code, is

amendedβ

(1) in subsection (b)β

(B) by striking ββ186(a),ββ;

(C) by striking ββ7512(a),ββ;

(D) in paragraph (8)(B) by striking ββ; orββ

and inserting a semicolon;
10
(E) in paragraph (9) by striking the period
11
at the end and inserting ββ; orββ; and
12
(F) by adding at the end the following:

ββ(10) other projects, if determined by the Sec-

retary, to be more cost-effective than projects de-

scribed in paragraphs (1) through (9).ββ;

State may use funds apportioned to the State under sec-

tion 104(b)(4) for any project in the State thatβ
