SEC. 2. CONSUMER PRODUCT SAFETY STANDARD FOR CER-

TAIN BATTERIES.

(a) CONSUMER PRODUCT SAFETY STANDARD RE-
3
QUIRED.—Not later than 180 days after the date of the
4
enactment of this Act, the Consumer Product Safety Com-
5
mission shall promulgate, under section 553 of title 5,
6
United States Code, a final consumer product safety
7
standard for rechargeable lithium-ion batteries used in
8
micromobility devices within the jurisdiction of the Com-
9
mission, including electric bicycles and electric scooters,
10
to protect against the risk of fires caused by such bat-
11
teries.

(b) CPSC DETERMINATION OF SCOPE.—The Con-
13
sumer Product Safety Commission shall specify the types
14
of rechargeable lithium-ion batteries and the types of
15
micromobility devices within the jurisdiction of the Com-
16
mission that are within the scope of subsection (a) as part
17
of a standard promulgated under this section, as reason-
18
ably necessary to protect against the risk of fires caused
19
by rechargeable lithium-ion batteries in consumer prod-
20
ucts.

(c) TREATMENT OF STANDARD.—A consumer prod-
22
uct safety standard promulgated under subsection (a)
23
shall be treated as a consumer product safety rule promul-
24
gated under section 9 of the Consumer Product Safety Act
25
(15 U.S.C. 2058).
