SHORT TITLE. 1 This Act may be cited as the ‘‘Supporting Connectiv- 2 ity for Higher Education Students in Need Act’’. 3 SEC. 2. FUNDS TO SUPPORT. 4 (a) REGULATIONS REQUIRED.— 5 (1) IN GENERAL.—Not later than 14 days after 6 the date of enactment of this Act, the Assistant Sec- 7 retary, in consultation with the Secretary of Edu- 8 cation, shall promulgate regulations for the provi- 9 sion, from amounts made available from the Emer- 10 gency Higher Education Connectivity Fund estab- 11 lished under subsection (d)(1), of support to an in- 12 stitution of higher education for the purposes of pro- 13 viding eligible services and eligible equipment to stu- 14 dents of that institution. 15 (2) CONTENT.—The regulations promulgated 16 under paragraph (1) shall— 17 (A) prioritize support for— 18 (i) an institution of higher education 19 that is eligible to receive a grant under 20 part A or B of title III or title V of the 21 Higher Education Act of 1965 (20 U.S.C. 22 1057 et seq., 1060 et seq., 1101 et seq.), 23 including— 24 (I) a historically Black college or 25 university; 2 (III) a Tribal College or Univer- 3 sity; and 4 (IV) a minority-serving institu- 5 tion; and 6 (ii) a rural-serving institution; 7 (B) provide a mechanism to require an in- 8 stitution of higher education to prioritize the 9 provision of an eligible service or eligible equip- 10 ment to a student who— 11 (i) is eligible to receive a Federal Pell 12 Grant; 13 (ii) is a recipient of any other need- 14 based financial aid from the Federal Gov- 15 ernment, a State, or that institution of 16 higher education; 17 (iii) is eligible for a Lifeline qualifying 18 assistance program; 19 (iv) is a low-income individual, as that 20 term is defined in section 312(g) of the 21 Higher Education Act of 1965 (20 U.S.C. 22 1058(g)); 23 (v) is a first generation college stu- 24 dent, as that term is defined in section 25 VerDate Sep 11 2014 05:40 May 29, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H6814.IH H6814 pbinns on DSKJLVW7X2PROD with BILLS 4 •HR 6814 IH 646.7 of title 34, Code of Federal Regula- 1 tions (or any successor regulation); 2 (vi) has been approved to receive Fed- 3 eral or State unemployment insurance ben- 4 efits since March 1, 2020; or 5 (vii) the institution of higher edu- 6 cation believes lacks necessary connectivity 7 for participating in distance learning or 8 academic and student support services; 9 (C) establish a schedule of reasonable per- 10 student funding amounts for eligible services 11 and eligible equipment supported under those 12 regulations; 13 (D) provide that— 14 (i) an institution of higher education 15 that purchases eligible equipment using 16 support received under those regulations 17 may, after the termination of those regula- 18 tions under subsection (b), use that eligible 19 equipment for purposes that the institution 20 considers appropriate, subject to any re- 21 strictions provided in those regulations (or 22 any successor regulations that are promul- 23 gated on or before the termination date de- 24 VerDate Sep 11 2014 05:40 May 29, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H6814.IH H6814 pbinns on DSKJLVW7X2PROD with BILLS 5 •HR 6814 IH scribed in paragraph (1) of that sub- 1 section); 2 (ii) no person that receives support 3 under those regulations may sell or other- 4 wise transfer eligible support or eligible 5 equipment in exchange for anything (in- 6 cluding a service) of value, except that 7 such person may exchange that eligible 8 equipment for upgraded equipment of the 9 same type; and 10 (iii) an institution of higher education 11 may use support received under those reg- 12 ulations to provide eligible services and eli- 13 gible equipment in conjunction with other 14 Federal funding if the total amount of 15 Federal funding received by the institution 16 is not greater than the cost of so providing 17 the eligible services and eligible equipment; 2 (iii) with respect to reporting, record- 3 keeping, retention of documents, compli- 4 ance, and audits for an institution of high- 5 er education that receives support under 6 those regulations; 7 (iv) for payment and distribution of 8 support to institutions of higher education 9 under those regulations; and 10 (v) with respect to any other processes 11 that the Assistant Secretary, in consulta- 12 tion with the Secretary of Education, de- 13 termines to be appropriate. 14 (b) TERMINATION OF REGULATIONS.— 15 (1) IN GENERAL.—Subject to paragraph (2), 16 the regulations promulgated under subsection (a) 17 shall terminate on the date that is 60 days after the 18 date on which the public health emergency declared 19 by the Secretary of Health and Human Services 20 under section 319 of the Public Health Service Act 21 (42 U.S.C. 247d) with respect to COVID–19, or any 22 renewal of that declaration, terminates. 23 (2) CONTINUITY OF FUNDING.—If, during the 24 period in which the regulations promulgated under 25 VerDate Sep 11 2014 05:40 May 29, 2020 Jkt 099200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H6814.IH H6814 pbinns on DSKJLVW7X2PROD with BILLS 7 •HR 6814 IH subsection (a) are in effect, the Assistant Secretary 1 makes a commitment to provide support to an insti- 2 tution of higher education under those regulations, 3 the Assistant Secretary may make a payment with 4 respect to that commitment on any date that is on 5 or before September 30, 2021. 6 (c) EXEMPTIONS.— 7 (1) NOTICE AND COMMENT RULEMAKING RE- 8 QUIREMENTS.—Subsections (b), (c), and (d) of sec- 9 tion 553 of title 5, United States Code, shall not 10 apply with respect to a regulation promulgated 11 under subsection (a) of this section or a rulemaking 12 to promulgate such a regulation. 13 (2) PAPERWORK REDUCTION ACT REQUIRE- 14 MENTS.—A collection of information conducted or 15 sponsored under the regulations promulgated under 16 subsection (a) shall not constitute a collection of in- 17 formation for the purposes of subchapter I of chap- 18 ter 35 of title 44, United States Code (commonly re- 19 ferred to as the ‘‘Paperwork Reduction Act’’). 20 (d) EMERGENCY HIGHER EDUCATION 21 CONNECTIVITY FUND.— 22 (1) ESTABLISHMENT.—There is established in 23 the Treasury of the United States a fund to be 24 VerDate Sep 11 2014 05:40 May 29, 2020 Jkt 099200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H6814.IH H6814 pbinns on DSKJLVW7X2PROD with BILLS 8 •HR 6814 IH known as the ‘‘Emergency Higher Education Con- 1 nectivity Fund’’. 2 (2) APPROPRIATION.—There is appropriated to 3 the Emergency Higher Education Connectivity 4 Fund, out of any money in the Treasury not other- 5 wise appropriated, $1,000,000,000 for fiscal year 6 2020, to remain available through fiscal year 2021. 7 (3) USE OF FUNDS.—Amounts in the Emer- 8 gency Higher Education Connectivity Fund shall be 9 available to the Assistant Secretary to provide sup- 10 port under the regulations promulgated under sub- 11 section (a). 12 (e) RULE OF CONSTRUCTION.—Nothing in this sec- 13 tion, any regulation promulgated under this section, or 14 any policy established by an institution of higher education 15 to implement this section or a regulation promulgated 16 under this section may be construed to preclude any stu- 17 dent from receiving support provided under this section 18 or a regulation promulgated under this section. 19 (f) DEFINITIONS.—In this section: 20 (1) ASSISTANT SECRETARY.—The term ‘‘Assist- 21 ant Secretary’’ means the Assistant Secretary of 22 Commerce for Communications and Information. 23 (2) BROADBAND INTERNET ACCESS SERVICE.— 24 The term ‘‘broadband internet access service’’ has 25 VerDate Sep 11 2014 05:40 May 29, 2020 Jkt 099200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H6814.IH H6814 pbinns on DSKJLVW7X2PROD with BILLS 9 •HR 6814 IH the meaning given the term in section 8.1(b) of title 1 47, Code of Federal Regulations (or any successor 2 regulation). 3 (3) ELIGIBLE EQUIPMENT.—The term ‘‘eligible 4 equipment’’ means any of the following: 5 (A) A laptop computer, tablet computer, or 6 similar device capable of connecting to broad- 7 band internet access service. 8 (B) A modem. 9 (C) A router. 10 (D) A device that combines a modem and 11 a router. 12 (E) A Wi-Fi hotspot. 13 (4) ELIGIBLE SERVICE.—The term ‘‘eligible 14 service’’ means— 15 (A) broadband internet access service; and 16 (B) video-conferencing systems and serv- 17 ices used for distance learning. 18 (5) FEDERAL PELL GRANT.—The term ‘‘Fed- 19 eral Pell Grant’’ means a grant under section 401 20 of the Higher Education Act of 1965 (20 U.S.C. 21 1070a). 22 (6) HISPANIC-SERVING INSTITUTION.—The 23 term ‘‘Hispanic-serving institution’’ has the meaning 24 VerDate Sep 11 2014 05:40 May 29, 2020 Jkt 099200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H6814.IH H6814 pbinns on DSKJLVW7X2PROD with BILLS 10 •HR 6814 IH given the term in section 502 of the Higher Edu- 1 cation Act of 1965 (20 U.S.C. 1101a). 2 (7) HISTORICALLY BLACK COLLEGE OR UNI- 3 VERSITY.—The term ‘‘historically Black college or 4 university’’ has the meaning given the term ‘‘part B 5 institution’’ in section 322 of the Higher Education 6 Act of 1965 (20 U.S.C. 1061). 7 (8) INSTITUTION OF HIGHER EDUCATION.—The 8 term ‘‘institution of higher education’’ means— 9 (A) an institution of higher education, as 10 that term is defined in section 101 of the High- 11 er Education Act of 1965 (20 U.S.C. 1001); or 12 (B) a postsecondary vocational institution, 13 as that term is defined in section 102(c) of the 14 Higher Education Act of 1965 (20 U.S.C. 15 1002(c)). 16 (9) LIFELINE QUALIFYING ASSISTANCE 17 PROGAM.—The term ‘‘Lifeline qualifying assistance 18 program’’ means a program described in section 19 54.400(j) of title 47, Code of Federal Regulations 20 (or any successor regulation). 21 (10) MINORITY-SERVING INSTITUTION.—The 22 term ‘‘minority-serving institution’’ means any of 23 the following: 24 VerDate Sep 11 2014 05:40 May 29, 2020 Jkt 099200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\H6814.IH H6814 pbinns on DSKJLVW7X2PROD with BILLS 11 •HR 6814 IH (A) An Alaska Native-serving institution 1 (as that term is defined in section 317(b) of the 2 Higher Education Act of 1965 (20 U.S.C. 3 1059d(b))). 4 (B) A Native Hawaiian-serving institution 5 (as that term is defined in section 317(b) of the 6 Higher Education Act of 1965 (20 U.S.C. 7 1059d(b))). 8 (C) A Predominantly Black institution (as 9 that term is defined in section 371(c) of the 10 Higher Education Act of 1965 (20 U.S.C. 11 1067q(c))). 12 (D) An Asian American and Native Amer- 13 ican Pacific Islander-serving institution (as that 14 term is defined in section 320(b) of the Higher 15 Education Act of 1965 (20 U.S.C. 1059g(b))). 16 (E) A Native American-serving, nontribal 17 institution (as that term is defined in section 18 319(b) of the Higher Education Act of 1965 19 (20 U.S.C. 1059f(b))). 20 (F) A consortium of any of the following: 21 (i) A historically Black college or uni- 22 versity. 23 (ii) A Hispanic-serving institution. 24 (iii) A Tribal College or University. 25 VerDate Sep 11 2014 05:40 May 29, 2020 Jkt 099200 PO 00000 Frm 00011 Fmt 6652 Sfmt 6201 E:\BILLS\H6814.IH H6814 pbinns on DSKJLVW7X2PROD with BILLS 12 •HR 6814 IH (iv) An institution described in any of 1 subparagraphs (A) through (E). 2 (11) RURAL-SERVING INSTITUTION.—The term 3 ‘‘rural-serving institution’’ has the meaning given 4 the term ‘‘rural-serving institution of higher edu- 5 cation’’ in section 861(b) of the Higher Education 6 Act of 1965 (20 U.S.C. 1161q(b)). 7 (12) STATE.—The term ‘‘State’’ has the mean- 8 ing given the term in section 103 of the Higher 9 Education Act of 1965 (20 U.S.C. 1003). 10 (13) STUDENT.—The term ‘‘student’’, when 11 used with respect to an institution of higher edu- 12 cation, means an individual who, during the period 13 in which the individual receives support under the 14 regulations promulgated under subsection (a), is— 15 (A) registered as a student with the insti- 16 tution;
