SUPPLEMENTAL APPROPRIATIONS FOR THE DE- 1 PARTMENTS OF AGRICULTURE, THE INTE- 2 RIOR, HOMELAND SECURITY, LABOR, AND 3 COMMERCE. 4 (a) IN GENERAL.—The following amounts are appro- 5 priated, out of any amounts in the Treasury not otherwise 6 appropriated, for the fiscal year ending September 30, 7 2020, and for other purposes: 8 (1) FOREST SERVICE SUPPLEMENTAL APPRO- 9 PRIATIONS.—For additional amounts for the Forest 10 Service— 11 (A) $4,200,000,000 for ‘‘National Forest 12 System’’, to remain available through Sep- 13 tember 30, 2023, of which— 14 (i) $3,500,000,000 shall be used for 15 hazardous fuels management activities, 16 subject to the conditions that the Secretary 17 of Agriculture, acting through the Chief of 18 the Forest Service (referred to in this sub- 19 section as the ‘‘Secretary’’), shall— 20 (I) prioritize hazardous fuels re- 21 duction projects using those amounts 22 for projects— 23 (aa) for which any applica- 24 ble processes under the National 25 Environmental Policy Act of 26 VerDate Sep 11 2014 21:13 May 26, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S3684.IS S3684 pbinns on DSKJLVW7X2PROD with BILLS 3 •S 3684 IS 1969 (42 U.S.C. 4321 et seq.) 1 have been completed; and 2 (bb) that are noncommer- 3 cial; and 4 (II) complete and submit to the 5 Committee on Energy and Natural 6 Resources of the Senate and the Com- 7 mittee on Natural Resources of the 8 House of Representatives an annual 9 report describing the number of acres 10 of land on which projects carried out 11 using those amounts effectively miti- 12 gated wildfire risk; 13 (ii) $150,000,000 shall be deposited 14 in the Collaborative Forest Landscape Res- 15 toration Fund for ecological restoration 16 treatments, as authorized by section 17 4003(f) of the Omnibus Public Land Man- 18 agement Act of 2009 (16 U.S.C. 7303(f)); 19 (iii) $300,000,000 shall be used for 20 vegetation and watershed management, as 21 determined by watershed-scale analytical 22 assessments; and 23 (iv) $250,000,000 shall be used for 24 forest products; and 8 (ii) $300,000,000 shall be used for 9 the Forest Service Legacy Roads and 10 Trails Remediation Program established by 11 section 8 of Public Law 88–657 (as added 12 by section 4); 13 (C) $500,000,000 for ‘‘State and Private 14 Forestry’’, of which— 15 (i) $100,000,000, to remain available 16 through September 30, 2023, shall be used 17 for competitive grants under the land- 18 scape-scale restoration program established 19 under section 13A of the Cooperative For- 20 estry Assistance Act of 1978 (16 U.S.C. 21 2109a), of which $50,000,000 shall be 22 used to enter into contracts with Indian 23 tribes pursuant to the Indian Self-Deter- 24 VerDate Sep 11 2014 21:13 May 26, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S3684.IS S3684 pbinns on DSKJLVW7X2PROD with BILLS 5 •S 3684 IS mination and Education Assistance Act 1 (25 U.S.C. 5301 et seq.); 2 (ii) $100,000,000 shall be derived 3 from the Land and Water Conservation 4 Fund established under section 200302 of 5 title 54, United States Code, to be used for 6 the Forest Legacy Program, to remain 7 available until expended; 8 (iii) $100,000,000, to remain available 9 through September 30, 2023, shall be used 10 for the urban and community forestry pro- 11 gram; 12 (iv) $100,000,000, to remain available 13 through September 30, 2023, shall be used 14 for the community forest and open space 15 conservation program; and 16 (v) $100,000,000, to remain available 17 through September 30, 2023, shall be used 18 for State fire assistance (National Fire Ca- 19 pacity); and 20 (D) $100,000,000 for the purchase of per- 21 sonal protective equipment and other prepared- 22 ness and response expenses relating to COVID– 23 19, to remain available through September 30, 24 2023. 25 VerDate Sep 11 2014 21:13 May 26, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S3684.IS S3684 pbinns on DSKJLVW7X2PROD with BILLS 6 •S 3684 IS (2) NATURAL RESOURCES CONSERVATION 1 SERVICE.—For an additional amount for the Nat- 2 ural Resources Conservation Service, 3 $5,500,000,000 for ‘‘Conservation Operations’’, to 4 remain available through September 30, 2023, which 5 shall be used to fund alternative funding arrange- 6 ments under section 1271C(d) of the Food Security 7 Act of 1985 (16 U.S.C. 3871c(d)), the eligible part- 8 ner (as defined in section 1271A of that Act (16 9 U.S.C. 3871a)) with respect to which demonstrates 10 quantifiable and cost-efficient sediment and nutrient 11 reductions, and near-term job creation, subject to 12 the conditions that— 13 (A) the amounts shall be used— 14 (i) to fund high-impact resiliency 15 projects to restore watersheds, the eligible 16 partner (as so defined) with respect to 17 which demonstrates— 18 (I) quantifiable reductions to 19 nonpoint source pollution; or 20 (II) quantified water savings that 21 functionally benefit native fish and 22 wildlife species; and 23 (ii) to provide $200,000,000 in tech- 24 nical assessment funding to eligible part- 25 VerDate Sep 11 2014 21:13 May 26, 2020 Jkt 099200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\S3684.IS S3684 pbinns on DSKJLVW7X2PROD with BILLS 7 •S 3684 IS ners (as so defined) to analyze and quan- 1 tify the sediment and nutrient benefits in 2 advance of projects carried out using those 3 amounts, on a State-by-State and water- 4 shed-by-watershed basis, by December 31, 5 2022; and 6 (B) with respect to a project funded using 7 amounts made available under this paragraph— 8 (i) the project shall be approved on an 9 expedited basis; 10 (ii) the project shall receive 100 per- 11 cent Federal financial assistance, with eli- 12 gible partners (as so defined) managing 13 the projects receiving a 20 percent admin- 14 istrative rate; and 15 (iii) of the amount provided for the 16 project, not more than 15 percent shall be 17 used by the Secretary to provide technical 18 assistance and measure project results. 19 (3) COMMUNITY WOOD ENERGY AND WOOD IN- 20 NOVATION PROGRAM.—$100,000,000 for the Sec- 21 retary for competitive grants under the Community 22 Wood Energy and Wood Innovation Program estab- 23 lished under section 9013 of the Farm Security and 24 VerDate Sep 11 2014 21:13 May 26, 2020 Jkt 099200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\S3684.IS S3684 pbinns on DSKJLVW7X2PROD with BILLS 8 •S 3684 IS Rural Investment Act of 2002 (7 U.S.C. 8113), to 1 remain available through September 30, 2023. 2 (4) DEPARTMENT OF THE INTERIOR SUPPLE- 3 MENTAL APPROPRIATIONS.—For additional 4 amounts— 5 (A) for the Bureau of Land Manage- 6 ment— 7 (i) $2,000,000,000 for ‘‘Management 8 of Lands and Resources’’, to remain avail- 9 able until September 30, 2021, which shall 10 be used for hazardous fuels management 11 activities, subject to the conditions that the 12 Secretary of the Interior, acting through 13 the Director of the Bureau of Land Man- 14 agement, shall— 15 (I) prioritize hazardous fuels re- 16 duction projects using those amounts 17 for projects— 18 (aa) for which any applica- 19 ble processes under the National 20 Environmental Policy Act of 21 1969 (42 U.S.C. 4321 et seq.) 22 have been completed; and 9 (ii) $25,000,000 for ‘‘Oregon and 10 California Grant Lands’’; 11 (B) for the United States Fish and Wild- 12 life Service, $300,000,000 for ‘‘Resource Man- 13 agement’’, to remain available until September 14 30, 2021, of which— 15 (i) $150,000,000 shall be used for the 16 partners for fish and wildlife program; and 17 (ii) $150,000,000 shall be used for 18 migratory bird management under the 19 North American waterfowl joint ventures 20 program; 21 (C) for the Bureau of Reclamation, 22 $4,500,000,000 for ‘‘Water and Related Re- 23 sources’’, to remain available through Sep- 24 tember 30, 2023, which shall be used to carry 25 VerDate Sep 11 2014 21:13 May 26, 2020 Jkt 099200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\S3684.IS S3684 pbinns on DSKJLVW7X2PROD with BILLS 10 •S 3684 IS out the WaterSMART program authorized by 1 subtitle F of title IX of the Omnibus Public 2 Land Management Act of 2009 (42 U.S.C. 3 10361 et seq.)— 4 (i) subject to the conditions that— 5 (I) projects funded using those 6 amounts shall have— 7 (aa) quantifiable and high- 8 efficiency improvements to re- 9 gional drought resiliency; or 10 (bb) quantifiable increases 11 in streamflows that functionally 12 benefit native fish and wildlife 13 species; and 14 (II) the amount of a grant pro- 15 vided using those amounts shall be 16 not more than $50,000,000; and 17 (ii) of which $100,000,000 shall be 18 provided in technical assessment funding 19 to recipients of amounts under that pro- 20 gram to analyze and quantify the sediment 21 and nutrient benefits of projects carried 22 out using those amounts, on a State-by- 23 State basis, by December 31, 2022; 8 (ii) $20,000,000 shall be made avail- 9 able to Indian Tribes on a competitive 10 basis to build capacity for participation in 11 large landscape-scale forest health treat- 12 ments; and 13 (iii) $5,000,000 shall be used for a 14 workforce development initiative to recruit 15 and retain forestry professionals on Indian 16 land. 17 (5) DEPARTMENT OF HOMELAND SECURITY 18 SUPPLEMENTAL APPROPRIATIONS.—For an addi- 19 tional amount for the Department of Homeland Se- 20 curity for ‘‘Disaster Relief Fund’’, $100,000,000 for 21 the Building Resilient Infrastructure and Commu- 22 nities program under section 203 of the Robert T. 23 Stafford Disaster Relief and Emergency Assistance 24 Act (42 U.S.C. 5133), to remain available until Sep- 25 VerDate Sep 11 2014 21:13 May 26, 2020 Jkt 099200 PO 00000 Frm 00011 Fmt 6652 Sfmt 6201 E:\BILLS\S3684.IS S3684 pbinns on DSKJLVW7X2PROD with BILLS 12 •S 3684 IS tember 30, 2031, for the purposes of increasing 1 wildfire resiliency. 2 (6) DEPARTMENT OF LABOR APPROPRIA- 3 TIONS.—$9,000,000,000 for the Department of 4 Labor for the Civilian Conservation Corps program 5 established under subtitle E of title I of the Work- 6 force Innovation and Opportunity Act, to remain 7 available through September 30, 2022. 8 (7) DEPARTMENT OF COMMERCE SUPPLE- 9 MENTAL APPROPRIATIONS.—For an additional 10 amount for the Department of Commerce for ‘‘Oper- 11 ations, Research, and Facilities’’, $2,000,000,000 12 for the National Oceans and Coastal Security Fund 13 established under section 904 of the National 14 Oceans and Coastal Security Act (16 U.S.C. 7503) 15 to award grants under section 906 of that Act (16 16 U.S.C. 7505), to remain available until September 17 30, 2031, for the purposes of creating jobs, restoring 18 wetlands, dunes, reefs, marshes, kelp forests, 19 mangroves, and other living shorelines to reduce 20 flood risks, create habitat, and restart tourism. 21 (b) LOCAL BENEFIT; ENVIRONMENTAL ANALYSIS.— 22 To the extent practicable, in using amounts made avail- 23 able under subsection (a)(1), the Secretary of Agriculture, 24 acting through the Chief of the Forest Service— 25 VerDate Sep 11 2014 21:13 May 26, 2020 Jkt 099200 PO 00000 Frm 00012 Fmt 6652 Sfmt 6201 E:\BILLS\S3684.IS S3684 pbinns on DSKJLVW7X2PROD with BILLS 13 •S 3684 IS (1) is encouraged to enter into stewardship con- 1 tracting projects under section 604 of the Healthy 2 Forests Restoration Act of 2003 (16 U.S.C. 6591c) 3 in order to maximize the economic benefit for rural 4 communities; and 5 (2) shall carry out projects using those amounts 6 in accordance with section 104 of the Healthy For- 7 ests Restoration Act of 2003 (16 U.S.C. 6514). 8 (c) QUALIFIED YOUTH OR CONSERVATION CORPS.— 9 In carrying out projects using amounts made available 10 under paragraphs (1) through (4) of subsection (a), the 11 Secretary (as defined in subparagraphs (A) and (B) of 12 section 203(13) of the Public Lands Corps Act of 1993 13 (16 U.S.C. 1722(13))) shall— 14 (1) use qualified youth or conservation corps 15 (as defined in section 203 of that Act (16 U.S.C. 16 1722)) to the maximum extent practicable; 17 (2) consult with the National Association of 18 Service and Conservation Corps for the purpose of 19 identifying appropriate projects, activities, and work- 20 force development outcomes; and 21 (3) be authorized to use such amounts as are 22 necessary to pr [Text truncated for display.
