SHORT TITLE. 3 This Act may be cited as the ‘‘Rural Community Hos- 4 pital Demonstration Extension Act of 2020’’. 5 SEC. 2. 42 U.S.C. 1395ww note), is amended by 2 striking ‘‘10-year extension period’’ and inserting 3 ‘‘15-year extension period’’. 4 (2) CONFORMING AMENDMENTS FOR EXTEN- 5 SION.— 6 (A) EXTENSION OF DEMONSTRATION PE- 7 RIOD.—Subsection (g) of such section 410A is 8 amended— 9 (i) in the subsection heading, by strik- 10 ing ‘‘TEN-YEAR’’ and inserting ‘‘FIFTEEN- 11 YEAR’’; 12 (ii) in paragraph (1)— 13 (I) by striking ‘‘additional 10- 14 year’’ and inserting ‘‘additional 15- 15 year’’; and 16 (II) by striking ‘‘10-year exten- 17 sion period’’ and inserting ‘‘15-year 18 extension period’’; 19 (iii) in paragraph (2), by striking ‘‘10- 20 year extension period’’ and inserting ‘‘15- 21 year extension period’’; 22 (iv) in paragraph (3), by striking ‘‘10- 23 year extension period’’ and inserting ‘‘15- 24 year extension period’’; 4 (vi) in paragraph (5), by striking ‘‘10- 5 year extension period’’ and inserting ‘‘15- 6 year extension period’’; and 7 (vii) in subparagraph (A) of para- 8 graph (6), by striking ‘‘10-year extension 9 period’’ and inserting ‘‘15-year extension 10 period’’. 11 (B) RULE FOR HOSPITALS THAT ARE NOT 12 ORIGINAL PARTICIPANTS IN THE DEMONSTRA- 13 TION.—Paragraph (5) of subsection (g) of such 14 section 410A is amended— 15 (i) by striking ‘‘PROGRAM.—During’’ 16 and inserting ‘‘PROGRAM.— 17 ‘‘(A) CURES ACT EXTENSION.—During’’; 18 and 19 (ii) by adding at the end the following 20 new subparagraph: 21 ‘‘(B) ADDITIONAL EXTENSION.—During 22 the third 5 years of the 15-year extension pe- 23 riod, the Secretary shall apply the provisions of 24 paragraph (4) to rural community hospitals 25 VerDate Sep 11 2014 04:27 May 19, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H6753.IH H6753 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 6753 IH that are not described in paragraph (4) but are 1 participating in the demonstration program 2 under this section as of December 30, 2019, in 3 a similar manner as such provisions apply to 4 rural community hospitals described in para- 5 graph (4).’’. 6 (C) SOLICITATION OF APPLICATIONS.— 7 Subparagraph (A) of subsection (g)(6) of such 8 section 410A is amended— 9 (i) by striking ‘‘IN GENERAL.—The 10 Secretary’’ and inserting ‘‘IN GENERAL.— 11 ‘‘(i) CURES ACT SOLICITATION.—The 12 Secretary’’; and 13 (ii) by adding at the end the following 14 new clause: 15 ‘‘(ii) ADDITIONAL SOLICITATION.— 16 The Secretary shall, notwithstanding sub- 17 section (a)(2) or paragraph (2) of this sub- 18 section, not later than 120 days after the 19 date of the enactment of this clause, issue 20 a solicitation for applications to select up 21 to the maximum number of additional 22 rural community hospitals located in any 23 State to participate in the demonstration 24 program under this section for the third 5 25 VerDate Sep 11 2014 04:27 May 19, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H6753.IH H6753 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 6753 IH years of the 15-year extension period with- 1 out exceeding the limitation under para- 2 graph (3) of this subsection.’’. 3 (b) CLARIFICATION OF APPLICATION OF CASE MIX 4 ADJUSTMENT.—Subsection (b) of such section 410A is 5 amended by adding at the end the following new para- 6 graph: 7 ‘‘(3) CASE MIX ADJUSTMENT.—The Secretary 8 shall provide for an appropriate adjustment under 9 this paragraph to take into account variations in 10 case mix of rural community hospitals, using the 11 most recent case-mix data available.’’. 12 (c) CHANGE IN TIMING FOR REPORT.—Subsection 13 (e) of such section 410A is amended by striking ‘‘Not later 14 than August 1, 2018’’ and inserting ‘‘Not later than Au- 15 gust 1, 2023’’. 16 (d) CLARIFYING TECHNICAL AMENDMENTS.—Such 17 section 410A, as amended by subsections (a), (b), and (c), 18 is further amended— 19 (1) in subsection (a)(1), by inserting ‘‘of Health 20 and Human Services’’ after ‘‘Secretary’’;
