PURPOSE. 1 The purpose of this Act is to establish a United 2 States Multilateral Aid Review (referred to in this Act as 3 the ‘‘Review’’) to publicly assess the value of United States 4 Government investments in multilateral entities. 5 SEC. 3. APPROPRIATE CONGRESSIONAL COMMITTEES DE- 6 FINED. 7 In this Act, the term ‘‘appropriate congressional com- 8 mittees’’ means— 9 (1) the Committee on Foreign Relations of the 10 Senate; 11 (2) the Committee on Appropriations of the 12 Senate; 13 (3) the Committee on Foreign Affairs of the 14 House of Representatives; 15 (4) the Committee on Financial Services of the 16 House of Representatives; and 17 (5) the Committee on Appropriations of the 18 House of Representatives. 19 SEC. 4. OBJECTIVES. 20 The objectives of the Review are— 21 (1) to provide a tool to guide the United States 22 Government’s decision making and prioritization 23 with regard to funding multilateral entities; 24 VerDate Sep 11 2014 00:37 May 08, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S3626.IS S3626 pamtmann on DSKBC07HB2PROD with BILLS 3 •S 3626 IS (2) to provide a methodological basis for allo- 1 cating budgetary resources to entities that advance 2 relevant United States foreign policy objectives; 3 (3) to incentivize improvements in the perform- 4 ance of multilateral entities to achieve better out- 5 comes, including in developing, fragile, and crisis-af- 6 flicted regions; and 7 (4) to protect United States taxpayer invest- 8 ments in foreign assistance by promoting trans- 9 parency with regard to the funding of multilateral 10 entities. 11 SEC. 5. REPORT ON REVIEW. 8 (a) SUBMISSION.— 9 (1) IN GENERAL.—Not later than 21 months 10 after the date of the enactment of this Act, the 11 United States Multilateral Aid Review Task Force 12 established under section 7, in regular consultation 13 with the Peer Review Group established under sec- 14 tion 8, shall submit a report to the appropriate con- 15 gressional committees that describes the findings of 16 the Review. 17 (2) PUBLICATION.—The Secretary of State 18 shall publish the report described in paragraph (1) 19 on the internet website of the Department of State 20 not later than 15 days after the date on which the 21 report is submitted to the appropriate congressional 22 committees. 23 (b) METHODOLOGY.— 24 VerDate Sep 11 2014 00:37 May 08, 2020 Jkt 099200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\S3626.IS S3626 pamtmann on DSKBC07HB2PROD with BILLS 7 •S 3626 IS (1) USE OF CRITERIA.—The Task Force shall 1 establish an analytical framework and assessment 2 scorecard for the Review using the criteria set forth 3 in subsection (c). 4 (2) CONSULTATION WITH CONGRESS.—Not 5 later than 90 days after the appointments to the 6 Peer Review Group under section 8(b), the Task 7 Force shall submit the methodology for the Review 8 to the appropriate congressional committees. The 9 Task Force may not proceed with the Review until 10 30 days after submission of the methodology to the 11 appropriate congressional committees, taking into 12 consideration the views of the Chairmen and Rank- 13 ing Members of each of the appropriate congres- 14 sional committees. 15 (3) PUBLICATION OF CRITERIA AND METHOD- 16 OLOGY.—Final criteria and methodology shall be 17 published on the internet website of the Department 18 of State not later than 60 days after the submission 19 of the methodology to the appropriate congressional 20 committees under paragraph (2). 21 (c) ASSESSMENT CRITERIA.—The assessment score- 22 card shall include the following criteria: 23 (1) RELATIONSHIP OF STATED GOALS TO AC- 24 TUAL RESULTS.—The extent to which the stated 25 VerDate Sep 11 2014 00:37 May 08, 2020 Jkt 099200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\S3626.IS S3626 pamtmann on DSKBC07HB2PROD with BILLS 8 •S 3626 IS mission, goals, and objectives of the entity have been 1 achieved during the review period, including— 2 (A) an identification of the stated mission, 3 goals, and objectives of each entity; 4 (B) an evaluation of the extent to which 5 the entity met its stated implementation 6 timelines and achieved declared results; and 7 (C) an evaluation of whether the entity op- 8 timizes resources to achieve the stated mission, 9 goals, and objectives of the entity. 10 (2) RESPONSIBLE MANAGEMENT.—The extent 11 to which management of the entity follows best man- 12 agement practices, including— 13 (A) an evaluation of the ratio of manage- 14 ment and administrative expenses to program 15 expenses, including an evaluation of entity re- 16 sources spent on nonprogrammatic expenses; 17 (B) an evaluation of program expense 18 growth, including a comparison of the annual 19 growth of program expenses to the annual 20 growth of management and administrative ex- 21 penses; and 22 (C) an evaluation of whether the entity has 23 established appropriate levels of senior manage- 24 ment compensation. 25 VerDate Sep 11 2014 00:37 May 08, 2020 Jkt 099200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\S3626.IS S3626 pamtmann on DSKBC07HB2PROD with BILLS 9 •S 3626 IS (3) ACCOUNTABILITY AND TRANSPARENCY.— 1 The extent to which the policies and procedures of 2 the entity follow best practices of accountability and 3 transparency, taking into consideration credible re- 4 porting regarding unauthorized conversion or diver- 5 sion of entity resources, and including an evaluation 6 of whether the entity has— 7 (A) established and enforced appropriate 8 auditing procedures; 9 (B) established and enforced appropriate 10 rules to reduce the risk of conflicts of interest 11 among the senior leadership of the entity; 12 (C) established and enforced appropriate 13 whistleblower policies; 14 (D) established and maintained appro- 15 priate records retention policies and guidelines; 16 (E) established and maintained best prac- 17 tices with respect to transparency and public 18 disclosure; and 19 (F) established and maintained best prac- 20 tices with respect to disclosure of the compensa- 21 tion of senior leadership officials. 22 (4) ALIGNMENT WITH UNITED STATES FOREIGN 23 POLICY OBJECTIVES.—The extent to which the poli- 24 cies and practices of the entity align with relevant 25 VerDate Sep 11 2014 00:37 May 08, 2020 Jkt 099200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\S3626.IS S3626 pamtmann on DSKBC07HB2PROD with BILLS 10 •S 3626 IS United States foreign policy objectives, including an 1 evaluation of— 2 (A) the entity’s stated mission, goals, and 3 objectives in comparison to relevant United 4 States foreign policy objectives; 5 (B) any significant divergence between the 6 actions of the entity and relevant United States 7 foreign policy objectives; and 8 (C) whether continued participation by the 9 United States in the entity contributes a net 10 benefit towards achieving relevant United 11 States foreign policy objectives, including the 12 reasons for such conclusion. 13 (5) MULTILATERAL APPROACH COMPARED TO 14 BILATERAL APPROACH.—The extent to which pur- 15 suing relevant United States foreign policy objectives 16 through a multilateral approach is effective and cost- 17 efficient compared to, or complementary to, a bilat- 18 eral approach, including an evaluation of— 19 (A) whether relevant United States foreign 20 policy objectives are effectively pursued through 21 the entity, compared to existing or potential bi- 22 lateral approaches, including the criteria used 23 in the evaluation; and 24 VerDate Sep 11 2014 00:37 May 08, 2020 Jkt 099200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\S3626.IS S3626 pamtmann on DSKBC07HB2PROD with BILLS 11 •S 3626 IS (B) whether relevant United States foreign 1 policy objectives are pursued on a cost-effective 2 basis through the entity, including the amount 3 of funding leveraged from non-United States 4 Government sources, compared to existing or 5 potential bilateral approaches. 6 (6) REDUNDANCIES AND OVERLAP.—The extent 7 to which the mission, goals, and objectives of the en- 8 tity overlap with, or complement, the mission, goals, 9 objectives, and programs of other multilateral insti- 10 tutions to which the United States Government con- 11 tributes voluntary or assessed funding, whether cash 12 or in-kind, including— 13 (A) a comparison of the extent to which 14 relevant United States foreign policy objectives 15 are effectively pursued on a cost-effective basis 16 through each of the overlapping entities; and 17 (B) whether continued participation in 18 each entity contributes a benefit towards 19 achieving United States foreign policy objec- 20 tives. 21 SEC. 7. UNITED STATES MULTILATERAL REVIEW TASK 22 FORCE. 23 (a) ESTABLISHMENT.—The President shall establish 24 an interagency Multilateral Review Task Force (referred 25 VerDate Sep 11 2014 00:37 May 08, 2020 Jkt 099200 PO 00000 Frm 00011 Fmt 6652 Sfmt 6201 E:\BILLS\S3626.IS S3626 pamtmann on DSKBC07HB2PROD with BILLS 12 •S 3626 IS to in this Act as the ‘‘Task Force’’) to review and assess 1 United States participation in multilateral entities identi- 2 fied in section 5 and to develop and transmit to the appro- 3 priate congressional committees the report required under 4 section 6. 5 (b) LEADERSHIP.—The Task Force shall be chaired 6 by the Secretary of State. The Secretary may delegate his 7 or her responsibilities under this Act to an appropriate 8 senior Senate-confirmed Department of State official. 9 (c) MEMBERSHIP.—The President may appoint to 10 the interagency Task Force senior Senate-confirmed offi- 11 cials from the Department of State, the Department of 12 the Treasury, the United States Agency for International 13 Development, the Centers for Disease Control and Preven- 14 tion, the Department of Agriculture, the Department of 15 Energy, and any other relevant executive branch depart- 16 ment or agency. 17 (d) CONSULTATION.—In preparing the report under 18 section 6, including the initial review of methodology, the 19 Task Force shall consult regularly with the Peer Review 20 Group established under section 8. 21 VerDate Sep 11 2014 00:37 May 08, 2020 Jkt 099200 PO 00000 Frm 00012 Fmt 6652 Sfmt 6201 E:\BILLS\S3626.IS S3626 pamtmann on DSKBC07HB2PROD with BILLS 13 •S 3626 IS SEC. 8.
