To amend title 38, United States Code, to provide for the inclusion of
certain emblems on headstones and markers furnished for veterans by
the Secretary of Veterans Affairs, and for other purposes.

Mr. BRAUN (for himself, Ms. SINEMA, and Mrs. LOEFFLER) introduced the
following bill; which was read twice and referred to the Committee on
Veterans’ Affairs
A BILL
To amend title 38, United States Code, to provide for the
inclusion of certain emblems on headstones and markers
furnished for veterans by the Secretary of Veterans Af-
fairs, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION
1.
INCLUSION
OF
CERTAIN
EMBLEMS
ON
3
HEADSTONES AND MARKERS FURNISHED BY
4
THE SECRETARY OF VETERANS AFFAIRS.

(a) IN GENERAL.—Section 2306 of title 38, United
6
States Code, is amended—

(1) by redesignating subsection (i) as subsection
1
(j); and
2
(2) by inserting after subsection (h) the fol-
3
lowing new subsection (i):

‘‘(i)(1) A headstone or marker furnished for a veteran
5
under subsection (a), (b), or (d) may include—
6
‘‘(A) no emblem;
7
‘‘(B) an emblem of belief; or
8
‘‘(C) an emblem from among a list of emblems
9
that the Secretary of Defense, in coordination with
10
the Secretary, shall establish.
11
‘‘(2) The list established under paragraph (1)(C)
12
shall include the following:
13
‘‘(A) An emblem with respect to—
14
‘‘(i) each unit at the level of separate bri-
15
gade or higher in the Army and each equivalent
16
unit in the Navy, Marine Corps, Air Force, and
17
Coast Guard; and
18
‘‘(ii) each skill or combat badge or tab
19
earned by a member of the Armed Forces.

‘‘(B) One or more emblems of the commissioned
21
Regular Corps of the Public Health Service.
22
‘‘(C) One or more emblems of the commissioned
23
officer corps of the National Oceanic and Atmos-
24
pheric Administration.

‘‘(D) Such other emblems as the Secretary of

Defense, in coordination with the Secretary, con-
2
siders appropriate and practical, such as the Marine
3
Corps emblem or Army Infantry insignia.
4
‘‘(3) The Secretary of Defense shall provide the Sec-
5
retary with a digitized representation of each emblem in-
6
cluded in the list established under paragraph (1)(C).’’.

(b) ESTABLISHMENT OF LIST OF APPROVED EM-
8
BLEMS.—Not later than June 1, 2021, the Secretary of
9
Defense, in coordination with the Secretary of Veterans
10
Affairs, shall establish the list of approved emblems re-
11
quired by section 2306(i)(1)(C), as added by subsection
12
(a), in accordance with such section.

(c) AVAILABILITY
OF APPROVED EMBLEMS.—Not
14
later than October 1, 2021, the Secretary of Veterans Af-
15
fairs shall make the emblems on the list of approved em-
16
blems required by section 2306(i)(1)(C), as added by sub-
17
section (a), available for inclusion on headstones and
18
markers.

(d) APPLICABILITY.—The amendment made by sub-
20
section (a) shall apply with respect to headstones and
21
markers furnished by the Secretary of Veterans Affairs
22
after the date of the enactment of this Act.
