AMENDMENT TO TEMPORARY INCREASE IN MED- 1 ICAID FMAP PROVIDED DURING COVID–19 2 EMERGENCY PERIOD. 3 (a) IN GENERAL.—Subsection (a) of section 6008 of 4 the Families First Coronavirus Response Act (Public Law 5 116–127) is amended to read as follows: 6 ‘‘(a) TEMPORARY INCREASE IN MEDICAID FMAP.— 7 ‘‘(1) 50 STATES AND DISTRICT OF COLUMBIA.— 8 Subject to subsection (b), for each calendar quarter 9 occurring during the period beginning on the first 10 day of the emergency period defined in paragraph 11 (1)(B) of section 1135(g) of the Social Security Act 12 (42 U.S.C. 1320b–5(g)) and ending on the last day 13 of the calendar quarter in which the last day of such 14 emergency period occurs, the Federal medical assist- 15 ance percentage determined under section 1905(b) 16 of such Act (42 U.S.C. 1396d(b)) for a State that 17 is one of the 50 States or the District of Columbia 18 shall be increased by 6.2 percentage points. 19 ‘‘(2) TERRITORIES.—Subject to subsection (b), 20 for each calendar quarter occurring during the pe- 21 riod beginning on the first day of the emergency pe- 22 riod described in paragraph (1) and ending on the 23 later of the last day of the calendar quarter in which 24 the last day of such emergency period occurs or Sep- 25 tember 30, 2021, the Federal medical assistance 26 VerDate Sep 11 2014 04:06 May 02, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H6658.IH H6658 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 6658 IH percentage determined under section 1905(b) of the 1 Social Security Act (42 U.S.C. 1396d(b)) for a State 2 that is American Samoa, Guam, the Commonwealth 3 of the Northern Mariana Islands, Puerto Rico, or 4 the United States Virgin Islands shall be 100 per- 5 cent.’’. 6 (b) STATE DEFINED.—Section 6008 of the Families 7 First Coronavirus Response Act (Public Law 116–127) is 8 amended by adding at the end the following new sub- 9 section: 10 ‘‘(e) STATE DEFINED.—In this section, the term 11 ‘State’ has the meaning given such term in section 12 1101(a)(1) of the Social Security Act (42 U.S.C. 13 1301(a)(1)) for purposes of title XIX of such Act (42 14 U.S.C. 1396 et seq.).’’. 15 (c) CONFORMING AMENDMENTS.— 16 (1) Section 6008 of the Families First 17 Coronavirus Response Act (Public Law 116–127), as 18 amended by subsection (b), is further amended— 19 (A) in subsection (b)— 20 (i) in the matter preceding paragraph 21 (1), by striking ‘‘A State described in sub- 22 section (a) may not receive the increase de- 23 scribed in such subsection in the Federal 24 medical assistance percentage for such 25 VerDate Sep 11 2014 04:06 May 02, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H6658.IH H6658 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 6658 IH State’’ and inserting ‘‘A State may not re- 1 ceive the increase to the Federal medical 2 assistance percentage of the State de- 3 scribed in subsection (a)(1) or the Federal 4 medical assistance percentage described in 5 subsection (a)(2), as applicable’’; and 6 (ii) in paragraph (3), by striking ‘‘de- 7 scribed in subsection (a)’’ and inserting 8 ‘‘described in subsection (a)(1)’’; and 9 (B) in subsection (d), by striking ‘‘a State 10 shall not be ineligible for the increase to the 11 Federal medical assistance percentage of the 12 State described in subsection (a)’’ and inserting 13 ‘‘a State shall not be ineligible for the increase 14 to the Federal medical assistance percentage of 15 the State described in subsection (a)(1) or the 16 Federal medical assistance percentage described 17 in subsection (a)(2), as applicable,’’. 18 (2) Section 1905(ff) of the Social Security Act 19 (42 U.S.C. 1396d(ff)) is amended— 20 (A) in paragraph (2), by inserting after 21 ‘‘subject to section 1108(g)(7)(C)’’ the fol- 22 lowing: ‘‘and section 6008(a)(2) of the Families 23 First Coronavirus Response Act’’; and 24 VerDate Sep 11 2014 04:06 May 02, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H6658.IH H6658 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 6658 IH (B) in paragraph (3), by inserting after 1 ‘‘subject to section 1108(g)(8)(B)’’ the fol- 2 lowing: ‘‘and such section 6008(a)(2)’’. 3 (d) EFFECTIVE DATE.—The amendments made by 4 this section shall apply as if included in the enactment 5 of the Families First Coronavirus Response Act (Public 6 Law 116–127). 7 Æ VerDate Sep 11 2014 04:06 May 02, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H6658.IH H6658 kjohnson on DSK79L0C42PROD with BILLS
