HOMELAND SECURITY HIGHER EDUCATION ADVI- 1 SORY COUNCIL. 2 (a) IN GENERAL.—The Secretary of Homeland Secu- 3 rity (referred to in this section as the ‘‘Secretary’’) shall 4 establish a council to be known as the ‘‘Homeland Security 5 Higher Education Advisory Council’’ (referred to in this 6 section as the ‘‘Council’’). 7 (b) DUTIES OF COUNCIL.—The Council shall provide 8 advice and recommendations to the Secretary on matters 9 concerning homeland security and the academic commu- 10 nity, relating to the following: 11 (1) The threat of foreign influence and inter- 12 ference in the United States. 13 (2) Proposed regulatory changes impacting in- 14 stitutions of higher education (as such term is de- 15 fined in section 101 of the Higher Education Act of 16 1965 (20 U.S.C. 1001)). 17 (3) Promoting the openness of academic re- 18 search and the exchange of ideas between institu- 19 tions of higher education and the Federal Govern- 20 ment. 21 (4) Promoting campus resilience resources to 22 address a range of threats or hazards affecting insti- 23 tutions of higher education. 24 (5) Homeland security academic and research 25 programs. 26 VerDate Sep 11 2014 01:32 Apr 25, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H6588.IH H6588 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 6588 IH (6) Student and recent graduate recruitment to 1 Federal Government employment. 2 (7) Issues relating to international students, in- 3 cluding— 4 (A) obtaining and maintaining a visa; 5 (B) processing H–1B visas and Optional 6 Practical Training; 7 (C) monitoring student visa recipients who 8 stay past their authorized time in the United 9 States; and 10 (D) any other matters the Secretary con- 11 siders appropriate. 12 (8) Issues relating to undocumented students. 13 (9) Cybersecurity. 14 (c) MEMBERSHIP.— 15 (1) IN GENERAL.—The Council shall be com- 16 posed of at least 21 members appointed by the Sec- 17 retary, of whom 9 shall be from governmental posi- 18 tions specified in paragraph (2), and not fewer than 19 12 members shall be from nongovernmental posi- 20 tions specified in paragraph (3). 21 (2) GOVERNMENTAL POSITIONS.—Govern- 22 mental positions specified in this paragraph are the 23 following: 24 VerDate Sep 11 2014 01:32 Apr 25, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H6588.IH H6588 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 6588 IH (A) The Bureau of Consular Affairs of the 1 Department of State. 2 (B) The Bureau of Education and Cultural 3 Affairs of the Department of State. 4 (C) U.S. Customs and Border Protection. 5 (D) The Office of Civil Rights and Civil 6 Liberties of the Department of Homeland Secu- 7 rity. 8 (E) The Office of Science and Technology 9 Cooperation of the Department of State. 10 (F) The Student and Exchange Visitor 11 Program of the Department of Homeland Secu- 12 rity. 13 (G) United States Citizenship and Immi- 14 gration Services. 15 (H) Office of the Citizenship and Immigra- 16 tion Services Ombudsman. 17 (I) Homeland Security Investigations of 18 the U.S. Immigration and Customs Enforce- 19 ment. 20 (J) The Department of Justice. 21 (K) The intelligence community (as such 22 term is defined in section 3(4) of the National 23 Security Act of 1947 (50 U.S.C. 3003(4))). 24 VerDate Sep 11 2014 01:32 Apr 25, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H6588.IH H6588 pamtmann on DSKBC07HB2PROD with BILLS 5 •HR 6588 IH (3) NONGOVERNMENTAL POSITIONS.—Non- 1 governmental positions specified in this paragraph 2 are the following: 3 (A) Twelve presidents or chancellors of a 4 university, with a distribution of such univer- 5 sities being private, public, and regionally di- 6 verse. 7 (B) Senior leaders of relevant higher edu- 8 cation associations. 9 (4) TIMING OF APPOINTMENTS.—Appointments 10 to the Council shall be made not later than 4 11 months after the date of the enactment of this Act. 12 (5) TERMS.— 13 (A) IN GENERAL.—Each member shall be 14 appointed for a term of 2 years. 15 (B) VACANCIES.—Any member appointed 16 to fill a vacancy occurring before the expiration 17 of the term for which the member’s predecessor 18 was appointed shall be appointed only for the 19 remainder of that term. A member may serve 20 after the expiration of that term until a suc- 21 cessor has been appointed. 22 (6) CHAIRPERSON AND VICE CHAIRPERSON.— 23 The Chairperson and Vice Chairperson of the Coun- 24 cil shall be designated by the Secretary at the time 25 VerDate Sep 11 2014 01:32 Apr 25, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H6588.IH H6588 pamtmann on DSKBC07HB2PROD with BILLS 6 •HR 6588 IH of the appointment of the members pursuant to 1 paragraph (4), and when a vacancy of the Chair- 2 person or Vice Chairperson occurs, as the case may 3 be. 4 (d) MEETING.— 5 (1) INITIAL MEETING.—The Council shall hold 6 its initial meeting not later than 30 days after the 7 final appointment of all members under subsection 8 (c)(4). 9 (2) MEETINGS.—The Council shall meet not 10 fewer than 3 times each year at the call of the 11 Chairperson or Vice Chairperson. 12 (3) QUORUM.—Sixteen members of the Council, 13 of whom 8 members appointed from governmental 14 positions and 8 members appointed from nongovern- 15 mental positions, shall constitute a quorum. 16 (e) COMPENSATION.— 17 (1) PROHIBITION OF COMPENSATION.—Except 18 as provided in paragraph (2), members of the Coun- 19 cil may not receive additional pay, allowances, or 20 benefits by reason of their service on the Council. 21 (2) TRAVEL EXPENSES.—Each member shall 22 receive travel expenses, including per diem in lieu of 23 subsistence, in accordance with applicable provisions 24 VerDate Sep 11 2014 01:32 Apr 25, 2020 Jkt 099200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H6588.IH H6588 pamtmann on DSKBC07HB2PROD with BILLS 7 •HR 6588 IH under subchapter I of chapter 57 of title 5, United 1 States Code. 2 (f) ADMINISTRATIVE SUPPORT SERVICES.—Upon the 3 request of the Council, the Secretary shall provide to the 4 Council, on a reimbursable basis, the administrative sup- 5 port services necessary for the Council to carry out its re- 6 sponsibilities under this Act. 7 (g) REPORT.—Not later than 180 days after the date 8 on which the Council holds its initial meeting under sub- 9 section (d) and annually thereafter, the Council shall sub- 10 mit a report containing a detailed statement of the advice 11 and recommendations of the Council pursuant to sub- 12 section (b) to each of the following: 13 (1) The Committee on Homeland Security of 14 the House of Representatives. 15 (2) The Committee on Homeland Security and 16 Governmental Affairs of the Senate. 17 (3) The Committee on the Judiciary of the 18 House of Representatives. 19 (4) The Committee on the Judiciary of the Sen- 20 ate. 21 (5) The Committee on Science, Space, and 22 Technology of the House of Representatives. 23 (6) The Committee on Commerce, Science, and 24 Transportation of the Senate. 25 VerDate Sep 11 2014 01:32 Apr 25, 2020 Jkt 099200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H6588.IH H6588 pamtmann on DSKBC07HB2PROD with BILLS 8 •HR 6588 IH (h) NONAPPLICABILITY OF FACA.—The Federal Ad- 1 visory Committee Act (5 U.S.C.
