Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. COMMISSION ON STRATEGIC NATIONAL STOCK- 3 PILE. 4 (a) ESTABLISHMENT.—There is established in the 5 legislative branch a commission to be known as the Com- 6 mission on the Strategic National Stockpile (in this sec- 7 tion referred to as the ‘‘Commission’’). 8 (b) DUTY OF COMMISSION.—The Commission shall 9 conduct a study to determine the most effective ways to 10 VerDate Sep 11 2014 03:40 May 01, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H6641.IH H6641 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 6641 IH stock the strategic national stockpile under section 319F– 1 2 of the Public Health Service Act (42 U.S.C. 247–6b) 2 in order to address local, State, and Federal needs in 3 times of emergency, including— 4 (1) the types of supplies needed; and 5 (2) the quantity of each such supply. 6 (c) MEMBERSHIP.— 7 (1) NUMBER AND APPOINTMENT.—The Com- 8 mission shall be composed of 10 members, of 9 whom— 10 (A) two members shall be appointed by the 11 President; 12 (B) two members shall be appointed by the 13 Speaker of the House of Representatives; 14 (C) two members shall be appointed by the 15 minority leader of the House of Representa- 16 tives; 17 (D) two members shall be appointed by the 18 majority leader of the Senate; and 19 (E) two members shall be appointed by the 20 minority leader of the Senate. 21 (2) TERMS.—Each member shall be appointed 22 for the life of the Commission. 23 (3) COMPENSATION.—Each member of the 24 Commission may be compensated at a rate not to 25 VerDate Sep 11 2014 03:40 May 01, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H6641.IH H6641 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 6641 IH exceed the daily equivalent of the annual rate of 1 basic pay in effect for a position at level IV of the 2 Executive Schedule under section 5315 of title 5, 3 United States Code, for each day during which such 4 member is engaged in the actual performance of the 5 duties of the Commission. 6 (d) ADMINISTRATIVE PROVISIONS.— 7 (1) STAFF.— 8 (A) APPOINTMENT AND COMPENSATION.— 9 The majority of the Commission, in accordance 10 with rules agreed upon by the Commission, may 11 appoint and fix the compensation of an execu- 12 tive director and such other personnel as may 13 be necessary to enable the Commission to carry 14 out its functions, without regard to the provi- 15 sions of title 5, United States Code, governing 16 appointments in the competitive service, and 17 without regard to the provisions of chapter 51 18 and subchapter III of chapter 53 of such title 19 relating to classification and General Schedule 20 pay rates, except that no rate of pay fixed 21 under this subsection may exceed the rate pay- 22 able for a position at level V of the Executive 23 Schedule under section 5316 of title 5, United 24 States Code. 25 VerDate Sep 11 2014 03:40 May 01, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H6641.IH H6641 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 6641 IH (B) PERSONNEL AS FEDERAL EMPLOY- 1 EES.— 2 (i) IN GENERAL.—The executive di- 3 rector and any other personnel of the Com- 4 mission appointed in accordance with sub- 5 paragraph (A) shall be treated as employ- 6 ees under section 2105 of title 5, United 7 States Code, for purposes of chapters 63, 8 81, 83, 84, 85, 87, 89, and 90 of such 9 title. 10 (ii) MEMBERS OF COMMISSION.— 11 Clause (i) may not be construed to apply 12 to members of the Commission. 13 (2) DETAILEES.—Any Federal Government em- 14 ployee may be detailed to the Commission without 15 reimbursement from the Commission, and such de- 16 tail shall be without interruption or loss of civil serv- 17 ice status, rights, or privilege. 18 (3) EXPERT AND CONSULTANT SERVICES.—The 19 Commission may procure the services of experts and 20 consultants in accordance with section 3109 of title 21 5, United States Code, at rates not to exceed the 22 daily rate paid a person occupying a position at level 23 IV of the Executive Schedule under section 5315 of 24 title 5, United States Code. 25 VerDate Sep 11 2014 03:40 May 01, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H6641.IH H6641 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 6641 IH (e) REPORT.—Not later than 1 year after the date 1 of the enactment of this Act, the Commission shall trans- 2 mit to Congress a report on the study required under sub- 3 section (b). 4 (f) TERMINATION.—The Commission shall terminate 5 immediately following the submission of the report re- 6 quired under subsection (e). 7 Æ VerDate Sep 11 2014 03:40 May 01, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H6641.IH H6641 kjohnson on DSK79L0C42PROD with BILLS
