To provide additional amounts to the Public Health and
Social Services Emergency Fund, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Helping Hospitals in
4
Need Act’’.
5
SEC. 2. ADDITIONAL FUNDING FOR THE PUBLIC HEALTH
6
AND SOCIAL SERVICES EMERGENCY FUND.

(a) ADDITIONAL APPROPRIATION.—There is hereby
8
appropriated, out of any amounts in the Treasury not oth-
9
erwise appropriated, $100,000,000,000 for an additional

amount for ‘‘Department of Health and Human Serv-

ices—Office of the Secretary—Public Health and Social
2
Services Emergency Fund’’, to be merged with amounts
3
made available to such account by division B of the
4
Coronavirus Aid, Relief, and Economic Security Act (Pub-
5
lic Law 116–136).

(b) PURPOSES OF FUNDS.—The Secretary of Health
7
and Human Services shall seek to obligate and expend the
8
amount appropriated by subsection (a) in a manner that
9
prioritizes funding for—
10
(1) hospitals and health care providers that the
11
Secretary determines serve a high proportion of un-
12
insured or low income patients, including based on—
13
(A) whether the hospital has received dis-
14
proportionate share hospital payments under
15
section 1886(r) of the Social Security Act (42
16
U.S.C. 1395ww) with respect to fiscal year
17
2019;
18
(B) whether the hospital has received dis-
19
proportionate share hospital payments under
20
section 1925 of such Act (42 U.S.C. 1396r–6)
21
with respect to fiscal year 2019; and
22
(C) any other factors specified by the Sec-
23
retary, including whether the hospital is identi-

fied as a ‘‘safety-net hospital’’ by the National
1
Academy of Medicine; and
2
(2) States, including the District of Columbia
3
and the territories or possessions of the United
4
States, that the Secretary, in coordination with the
5
Director of the Centers for Disease Control and Pre-
6
vention, determines to have the highest per capita
7
hospitalization rates for confirmed cases of COVID–
8
19.
