A BILL
To amend the Immigration and Nationality Act by extending
the period of time for which a conditional permit to
land temporarily may be granted to an alien seafarer
engaged in ship-to-ship cargo transfer operations, and
for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Landing Pass Exten-
4
sion Act of 2020’’.

SEC. 2. EXTENSION OF TIME FOR A CONDITIONAL PERMIT

TO LAND TEMPORARILY.

Section 252 of the Immigration and Nationality Act
3
(8 U.S.C. 1282(a)) is amended—
4
(1) in subsection (a)—
5
(A) in the matter preceding paragraph
6
(1)—
7
(i) by striking ‘‘(a) No alien crew-
8
man’’ and inserting ‘‘(a)(1) No alien crew-
9
man’’;
10
(ii) by striking ‘‘he may’’ and insert-
11
ing ‘‘the immigration officer may’’; and
12
(iii) by striking ‘‘his discretion’’ and
13
inserting ‘‘the immigration officer’s discre-
14
tion’’;
15
(B) by redesignating paragraphs (1), (2),
16
and (3) as subparagraphs (A), (B), and (C), re-
17
spectively;
18
(C) in subparagraph (A), as redesig-
19
nated—
20
(i) by striking ‘‘twenty–nine’’ and in-
21
serting ‘‘29’’;
22
(ii) by striking ‘‘he’’ each place such
23
term appears and inserting ‘‘the crew-
24
man’’; and
25
(iii) by striking ‘‘or’’ at the end;

(D) in subparagraph (B), as redesig-

(i) by striking ‘‘twenty-nine’’ and in-

serting ‘‘29’’;

(ii) by striking ‘‘he’’ each place such

term appears and inserting ‘‘the crew-

man’’;

(iii) by striking ‘‘one’’ and inserting

‘‘vessel or aircraft’’; and
9
(iv) by striking the period at the end

and inserting ‘‘; or’’; and

(E) by adding at the end the following:

‘‘(C) 180 days, if the immigration officer is
13
satisfied that the crewman intends to depart,
14
within the period for which the crewman is per-
15
mitted to land, on a vessel other than the vessel
16
on which the crewman arrived and that the
17
crewman will perform ship-to-ship cargo trans-
18
fer operations to or from any other vessel en-
19
gaged in foreign trade.

‘‘(2) Notwithstanding any other provision of
21
law, the period of admission for an alien who is a
22
nonimmigrant under section 101(a)(15)(C) in imme-
23
diate and continuous transit through the United
24
States to a vessel performing ship-to-ship cargo

ceed, 180 days.’’; and

(2) in subsection (b), by striking ‘‘subsection
3
(a)(1)’’ and inserting ‘‘subsection (a)(1)(A)’’.
