following bill; which was referred to the Committee on Energy and Commerce
A BILL
To amend the Public Health Service Act to authorize the
acceptance of gifts for the Strategic National Stockpile,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Stockpiling for Amer-
4
ica’s Future Endeavors Act of 2020’’.
5
SEC. 2. STRATEGIC NATIONAL STOCKPILE.
6
Section 319F–2(a) of the Public Health Service Act
7
(42 U.S.C. 247d–6b(a)) is amended by adding at the end
8
the following:

‘‘(6) ACCEPTANCE OF GIFTS.—

‘‘(A) IN
GENERAL.—The Secretary may,
1
without further appropriation and without fiscal
2
year limitation, accept, use, and dispose of
3
gifts, bequests, or devises of money, services, or
4
property, both real and personal, for the pur-
5
pose of carrying out this subsection. Any such
6
gift, bequest, or devise of money and proceeds
7
from sales of other property received as a gift,
8
bequest, or devise shall be deposited in the
9
Treasury and shall be available for obligation
10
and expenditure upon order of the Secretary.
11
‘‘(B) LIMITATION.—The Secretary may
12
not accept a gift, bequest, or devise under this
13
paragraph if the Secretary determines that the
14
use of the property or services would com-
15
promise the integrity or appearance of integrity
16
of—
17
‘‘(i) a program of the Department of
18
Health and Human Services; or
19
‘‘(ii) an individual involved in a pro-
20
gram of the Department.

‘‘(C) REPORT.—

‘‘(i) IN
GENERAL.—The Secretary

shall submit to the Committee on Energy

and Commerce of the House of Represent-

atives and the Committee on Health, Edu-

cation, Labor, and Pensions of the Senate
2
an annual report disclosing—
3
‘‘(I) any gift, bequest, or devise
4
that was accepted under this para-
5
graph during the year covered by the
6
report;
7
‘‘(II) how the gifts, bequests, and
8
devises contribute to the mission of
9
the stockpile; and
10
‘‘(III) the amount of Federal sav-
11
ings that were generated from the ac-
12
ceptance of the gifts, bequests, and
13
devises.
14
‘‘(ii) PUBLICATION.—Each report re-
15
quired under clause (i) shall be made pub-
16
lically available.’’.
