A BILL
To provide for the exemption of certain earnings from the
retirement earnings test, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Health Care Worker
4
and First Responder Social Security Beneficiaries Choice
5
Act’’.

SEC. 2. EXEMPTION OF CERTAIN EARNINGS FROM RETIRE-
7
MENT EARNINGS TEST.

(a) IN GENERAL.—For purposes of subsection (b) of
9
section 203 of the Social Security Act (42 U.S.C. 403(b)),

wages paid to an individual who attests to being employed

in the healthcare workforce or as a first responder (as de-
2
termined by the Commissioner of Social Security) for
3
months beginning with January 2020, and ending with
4
December 2020, shall not be included in the determination
5
of the individual’s excess earnings under subsection (f)(3)
6
of such section for any taxable year.

(b) GUIDANCE.—Not later than 30 days after the
8
date of the enactment of this Act, the Commissioner of
9
Social Security shall issue guidance providing for appro-
10
priate procedures for the implementation of subsection
11
(a).
