A BILL
To increase the amount available under the Defense Produc-
tion Act of 1950 to respond to the coronavirus epidemic,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. INCREASE IN AUTHORIZATIONS.

(a) AUTHORIZATIONS.—In addition to amounts oth-
4
erwise authorized to be appropriated, there is authorized
5
to be appropriated in the aggregate $3,000,000,000 for
6
fiscal year 2020 and 2021 to carry out titles I and III
7
of the Defense Production Act of 1950 to produce medical
8
ventilators, personal protection equipment, and other criti-

cally needed medical supplies and to carry out any other

actions necessary to respond to the COVID–19 emergency.

(b) CARRYOVER FUNDS.—Section 304(e) of the De-
3
fense Production Act of 1950 shall not apply at the close
4
of fiscal year 2020.
5
(c) COVID–19 EMERGENCY.—In this Act, the term
6
‘‘COVID–19 emergency’’ means the emergency declared
7
on March 13, 2020, by the President under the Robert
8
T. Stafford Disaster Relief and Emergency Assistance Act
9
(42 U.S.C. 4121 et seq.) relating to the Coronavirus Dis-
10
ease 2019 (COVID-19) pandemic.

SEC. 2. STRENGTHENING CONGRESSIONAL OVERSIGHT;

PUBLIC PORTAL.
13
(a) IN GENERAL.—Not later than three months after
14
the date of enactment of this Act, and every three months
15
thereafter, the Secretary of Commerce, in coordination
16
with the Secretary of Health and Human Services, the
17
Secretary of Defense, and any other Federal department
18
or agency that has utilized authority under title I or title
19
III of the Defense Production Act of 1950 to respond to
20
the COVID–19 emergency, shall submit a report to the
21
Committee on Financial Services of the House of Rep-
22
resentatives and the Committee on Banking, Housing, and
23
Urban Affairs of the Senate—

(1) on the use of such authority and the ex-
1
penditure of any funds in connection with such au-
2
thority; and
3
(2) that includes details of each purchase order
4
made using such authorities, including the product
5
and amount of product ordered and the entity that
6
fulfilled the contract.

(b) PUBLIC AVAILABILITY.—The Secretary of Com-
8
merce shall place all reports submitted under subsection
9
(a) on an appropriate website available to the public, in
10
an easily searchable format.
11
(c) SUNSET.—The requirements under this section
12
shall terminate after the expenditure of all funds appro-
13
priated pursuant to the authorizations under section 1.
