A BILL
To set aside certain funds for supplementary safety measures
and alternative safety measures for railway-highway
grade crossings, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Every Person Deserves
4
Peace and Quiet Act of 2020’’.

SEC. 2. RAIL IMPROVEMENT SET-ASIDE FOR SUPPLE-

MENTARY AND ALTERNATIVE SAFETY MEAS-
2
URES.

(a) IN GENERAL.—Section 22907 of title 49, United
4
States Code, is amended by adding at the end the fol-
5
lowing:
6
‘‘(m) SUPPLEMENTARY AND ALTERNATIVE SAFETY
7
MEASURES.—Of the amounts appropriated under this sec-
8
tion, 10 percent shall be available for supplementary safe-
9
ty measures and alternative safety measures, as those
10
terms are defined in section 222.9 of title 49, Code of Fed-
11
eral Regulations.’’.

(b) AUTHORIZATION OF APPROPRIATIONS.—Section
13
11102 of the FAST Act (Public Law 114–94) is amended
14
in subsection (a) by striking paragraphs (1) through (5)
15
and inserting the following:
16
‘‘(1) For fiscal year 2021, $330,000,000.
17
‘‘(2) For fiscal year 2022, $350,000,000.
18
‘‘(3) For fiscal year 2023, $370,000,000.
19
‘‘(4) For fiscal year 2024, $390,000,000.
20
‘‘(5) For fiscal year 2025, $410,000,000.’’.

SEC. 3. RAILWAY-HIGHWAY CROSSINGS.

Section 130 of title 23, United States Code, is

amended—

(1) in subsection (a)—

(A) by striking ‘‘and projects at grade

crossings’’ and inserting ‘‘projects at grade

crossings’’; and

(B) by inserting ‘‘and supplementary safe-
4
ty measures and alternative safety measures, as
5
those terms are defined in section 222.9 of title
6
49, Code of Federal Regulations,’’ after ‘‘idling
7
trains,’’; and
8
(2) in subsection (f)(3) by inserting ‘‘, except
9
that the Federal share for supplementary safety
10
measures and alternative safety measures described
11
under subsection (a) shall be 100 percent’’ before
12
the period at the end.

SEC. 4. SURFACE TRANSPORTATION BLOCK GRANT PRO-
14
GRAM.

Section 133(b)(4) of title 23, United States Code, is
16
amended by inserting ‘‘and supplementary safety meas-
17
ures and alternative safety measures, as those terms are
18
defined in section 222.9 of title 49, Code of Federal Regu-
19
lations’’, after ‘‘grade crossings’’.
