Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Lander County Land 4 Management and Conservation Act’’. 5 SEC. 2. FINDINGS. 6 Congress finds that— 7 (1) wildland fires pose a threat to public and 8 private natural resources in Lander County, Nevada; 9 VerDate Sep 11 2014 03:23 Mar 20, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S3465.IS S3465 kjohnson on DSK79L0C42PROD with BILLS 2 •S 3465 IS (2) expanding and improving the airports in 1 Lander County, Nevada, through the inclusion of 2 available adjacent land would support firefighting 3 capabilities in the County; 4 (3) the protection, development, and use of 5 water resources in Lander County, Nevada, play a 6 key role in major economic activities for the County, 7 including commercial development, mining, agri- 8 culture, tourism, recreational activity, and conserva- 9 tion; and 10 (4) recreational and public park opportunities 11 in Lander County, Nevada, could be substantially 12 enhanced through expansion of the park system in 13 the County. 14 SEC. 3. DEFINITIONS. 15 In this Act: 16 (1) COUNTY.—The term ‘‘County’’ means 17 Lander County, Nevada. 18 (2) MAP.—The term ‘‘Map’’ means the map en- 19 titled ‘‘Lander County Selected Lands’’ and dated 20 February 21, 2020. 21 (3) SECRETARY.—The term ‘‘Secretary’’ means 22 the Secretary of the Interior. 23 (4) SECRETARY CONCERNED.—The term ‘‘Sec- 24 retary concerned’’ means— 25 VerDate Sep 11 2014 03:23 Mar 20, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S3465.IS S3465 kjohnson on DSK79L0C42PROD with BILLS 3 •S 3465 IS (A) the Secretary, with respect to land 1 under the jurisdiction of the Secretary; and 2 (B) the Secretary of Agriculture, acting 3 through the Chief of the Forest Service, with 4 respect to National Forest System land. 5 SEC. 4. CONVEYANCES TO LANDER COUNTY, NEVADA. 6 (a) CONVEYANCE FOR WATERSHED PROTECTION, 7 RECREATION, AND PARKS.—Notwithstanding the land use 8 planning requirements of sections 202 and 203 of the Fed- 9 eral Land Policy and Management Act of 1976 (43 U.S.C. 10 1712, 1713), not later than 60 days after the date on 11 which the County identifies the parcels of Federal land 12 selected by the County for conveyance to the County from 13 among the parcels identified on the Map as ‘‘Lander 14 County Parcels BLM and USFS’’, the Secretary con- 15 cerned shall convey to the County, subject to valid existing 16 rights and for no consideration, all right, title, and interest 17 of the United States in and to the identified parcels of 18 Federal land (including mineral rights) for use by the 19 County for watershed protection, recreation, and parks. 20 (b) CONVEYANCE FOR AIRPORT FACILITY.— 21 (1) IN GENERAL.—Notwithstanding the land 22 use planning requirements of sections 202 and 203 23 of the Federal Land Policy and Management Act of 24 1976 (43 U.S.C. 1712, 1713), the Secretary shall 25 VerDate Sep 11 2014 03:23 Mar 20, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S3465.IS S3465 kjohnson on DSK79L0C42PROD with BILLS 4 •S 3465 IS convey to the County, subject to valid existing 1 rights, including mineral rights, all right, title, and 2 interest of the United States in and to the parcels 3 of Federal land identified on the Map as ‘‘Kingston 4 Airport’’ for the purpose of improving the relevant 5 airport facility and related infrastructure. 6 (2) COSTS.—The only costs for the conveyance 7 to be paid by the County under paragraph (1) shall 8 be the survey costs relating to the conveyance. 9 (c) SURVEY.—The exact acreage and legal descrip- 10 tion of any parcel of Federal land to be conveyed under 11 subsection (a) or (b) shall be determined by a survey satis- 12 factory to the Secretary concerned and the County. 13 (d) REVERSIONARY CLAUSE REQUIRED.—A convey- 14 ance of Federal land under subsection (a) or (b) shall in- 15 clude a reversionary clause to ensure that management of 16 the Federal land conveyed under the applicable subsection 17 shall revert to the Secretary concerned if the Federal land 18 is no longer being managed in accordance with the appli- 19 cable subsection. 20 (e) MAP, ACREAGE ESTIMATES, AND LEGAL DE- 21 SCRIPTIONS.— 22 (1) MINOR ERRORS.—The Secretary concerned 23 and the County may, by mutual agreement— 24 VerDate Sep 11 2014 03:23 Mar 20, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S3465.IS S3465 kjohnson on DSK79L0C42PROD with BILLS 5 •S 3465 IS (A) make minor boundary adjustments to 1 the parcels of Federal land to be conveyed 2 under subsection (a) or (b); and 3 (B) correct any minor errors in the Map, 4 an acreage estimate, or legal description of any 5 parcel of Federal land conveyed under sub- 6 section (a) or (b). 7 (2) CONFLICT.—If there is a conflict between 8 the Map, an acreage estimate, or a legal description 9 of Federal land conveyed under subsection (a) or 10 (b), the Map shall control unless the Secretary con- 11 cerned and the County mutually agree otherwise. 12 (3) AVAILABILITY.—The Secretary shall make 13 the Map available for public inspection in— 14 (A) the Office of the Nevada State Direc- 15 tor of the Bureau of Land Management; and 16 (B) the Bureau of Land Management Bat- 17 tle Mountain Field Office. 18 Æ VerDate Sep 11 2014 03:23 Mar 20, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\S3465.IS S3465 kjohnson on DSK79L0C42PROD with BILLS
