A BILL
To amend title 38, United States Code, to provide for family
and medical leave for certain Department of Veterans
Affairs employees, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘VA Family Leave Act
4
of 2020’’.

SEC. 2. FAMILY AND MEDICAL LEAVE FOR CERTAIN DE-

PARTMENT OF VETERANS AFFAIRS EMPLOY-

EES.

(a) TITLE 38 EMPLOYEES.—Section 7425 of title 38,
4
United States Code, is amended—
5
(1) in subsection (b), by striking ‘‘Notwith-
6
standing’’ and inserting ‘‘Except as provided in sub-
7
section (c), and notwithstanding’’; and
8
(2) by adding at the end the following:

‘‘(c) Notwithstanding any other provision of this sub-
10
chapter, the Administration shall provide to individuals
11
appointed to any position described in section 7421(b) who
12
are employed by the Administration family and medical
13
leave in the same manner, to the maximum extent prac-
14
ticable, as family and medical leave is provided under sub-
15
chapter V of chapter 63 of title 5 to employees, as defined
16
in section 6381(1) of such title.’’.

(b) APPLICABILITY.—The amendments made by sub-
18
section (a) shall not be effective with respect to any event
19
for which leave may be taken under subchapter V of chap-
20
ter 63 of title 5, United States Code, occurring before Oc-
21
tober 1, 2020.
