Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Capital Investment 4 Grant Program Improvement Act of 2020’’. 5 SEC. 2. CAPITAL INVESTMENT GRANT PROGRAM. 6 (a) AUTHORIZATION OF APPROPRIATIONS.—Section 7 5338(d) of title 49, United States Code, is amended— 8 (1) by striking ‘‘Federal Public Transportation 9 Act of 2015, $2,301,785,760’’ and inserting the fol- 10 VerDate Sep 11 2014 00:57 Mar 05, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S3387.IS S3387 pamtmann on DSKBC07HB2PROD with BILLS 2 •S 3387 IS lowing: ‘‘Federal Public Transportation Act of 1 2015— 2 ‘‘(A) $2,301,785,760’’; and 3 (2) by striking the period at the end and insert- 4 ing the following: ‘‘; and 5 ‘‘(B) $3,300,000,000 for each of fiscal 6 years 2021 through 2025.’’. 7 (b) CONSIDERATION OF INTEROPERABILITY.—Sec- 8 tion 5309(g)(2) of title 49, United States Code, is amend- 9 ed by adding at the end the following: 10 ‘‘(D) CONSIDERATION OF INTEROPER- 11 ABILITY.— 12 ‘‘(i) DEFINITIONS.—In this subpara- 13 graph— 14 ‘‘(I) the terms ‘commuter rail 15 passenger transportation’ and ‘inter- 16 city rail passenger transportation’ 17 have the meanings given those terms 18 in section 24102; and 19 ‘‘(II) the term ‘small urbanized 20 area’ means an urbanized area with a 21 population of less than 350,000 peo- 22 ple. 23 ‘‘(ii) CONSIDERATION OF INTEROPER- 24 ABILITY.—A new fixed guideway capital 25 VerDate Sep 11 2014 00:57 Mar 05, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S3387.IS S3387 pamtmann on DSKBC07HB2PROD with BILLS 3 •S 3387 IS project that receives a medium-low rating 1 for the project justification criteria under 2 subsection (d)(2)(A)(iii) shall nonetheless 3 be eligible for an overall rating of medium 4 under subparagraph (A) of this paragraph 5 if the Secretary determines that the project 6 would connect a small urbanized area to, 7 and be interoperable with, an existing (as 8 of the date of the grant application) inter- 9 city rail passenger transportation network, 10 commuter rail passenger transportation 11 network, or rail fixed guideway public 12 transportation system located within a 13 100-mile radius of a terminus of the 14 project.’’. 15 (c) REPORT ON SMALL-SCALE FIXED GUIDEWAY 16 PROJECTS.— 17 (1) DEFINITIONS.—In this subsection— 18 (A) the term ‘‘rural area’’ has the meaning 19 given the term in section 5302 of title 49, 20 United States Code; and 21 (B) the term ‘‘small urbanized area’’ has 22 the meaning given the term in section 5309(r) 23 of title 49, United States Code, as added by 24 subsection (b). 25 VerDate Sep 11 2014 00:57 Mar 05, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S3387.IS S3387 pamtmann on DSKBC07HB2PROD with BILLS 4 •S 3387 IS (2) REPORT.—Not later than 1 year after the 1 date of enactment of this Act, the Secretary of 2 Transportation shall issue a report on financing and 3 technical barriers to the construction and operation 4 of fixed guideway transportation projects with a 5 total estimated capital cost of not more than 6 $500,000 in small urbanized areas and rural areas. 7 Æ VerDate Sep 11 2014 00:57 Mar 05, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S3387.IS S3387 pamtmann on DSKBC07HB2PROD with BILLS
