A BILL
To clarify low or no emission vehicle project eligibility for
bus and bus facility competitive grants.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Low or No Emission
4
Bus Access Act of 2020’’.
5
SEC. 2. COMPETITIVE GRANTS FOR BUSES AND BUS FACILI-
6
TIES.
7
(a) IN GENERAL.—Section 5339(b)(1) of title 49,
8
United States Code, is amended—

(1) in subparagraph (A), by striking ‘‘and’’ at

the end;

(2) in subparagraph (B), by striking the period
3
at the end and inserting ‘‘; and’’; and
4
(3) by adding at the end the following:

‘‘(C) any eligible project (as defined in
6
subsection (c)(1)).’’.

(b) COMPETITIVE PROCESS.—Section 5339(b) of title
8
49, United States Code, is amended by adding at the end
9
the following:
10
‘‘(9) COMPETITIVE PROCESS.—
11
‘‘(A) SOLICITATION
OF
APPLICATIONS.—
12
Not later than 30 days after the date on which
13
amounts are made available for obligation
14
under this subsection for a full fiscal year, the
15
Secretary shall solicit grant applications for
16
projects under this subsection on a competitive
17
basis.
18
‘‘(B) GRANT
AWARDS.—The Secretary
19
shall award a grant under this subsection based
20
on a solicitation under subparagraph (A) of this
21
paragraph not later than the earlier of—
22
‘‘(i) 75 days after the date on which
23
the solicitation expires; or

‘‘(ii) the end of the fiscal year in

which the Secretary solicited the grant ap-

plications.’’.

SEC. 3. LOW OR NO EMISSION VEHICLE PROGRAM.

Section 5338(a) of title 49, United States Code, is
5
amended—
6
(1) in paragraph (1)—
7
(A) in subparagraph (D), by striking
8
‘‘and’’ at the end;
9
(B) in subparagraph (E), by striking the
10
period at the end and inserting ‘‘; and’’; and
11
(C) by adding at the end the following:
12
‘‘(F) $165,000,000 for each of fiscal years
13
2021 through 2025.’’; and
14
(2) in paragraph (2)(M)—
15
(A) by inserting ‘‘(i)’’ after ‘‘(M)’’;
16
(B) by striking ‘‘no or low’’ and inserting
17
‘‘low or no’’; and
18
(C) by adding at the end the following:
19
‘‘(ii) $165,000,000 for each of fiscal years
20
2021 through 2025 shall be available for low or
21
no emission grants under section 5339(c);
22
and’’.
