Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Employment Fairness 4 for Taiwan Act of 2020’’. 5 SEC. 2. SENSE OF THE CONGRESS. 6 It is the sense of the Congress that— 7 (1) Taiwan is responsible for remarkable 8 achievements in economic and democratic develop- 9 ment, with its per capita gross domestic product ris- 10 VerDate Sep 11 2014 04:38 Mar 03, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H6014.IH H6014 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 6014 IH ing in purchasing power parity terms from $3,470 in 1 1980 to more than $55,000 in 2018; 2 (2) the experience of Taiwan in creating a vi- 3 brant and advanced economy under democratic gov- 4 ernance and the rule of law can inform the work of 5 the international financial institutions, including 6 through the contributions and insights of Taiwanese 7 nationals; and 8 (3) Taiwanese nationals who seek employment 9 at the international financial institutions should not 10 be held at a disadvantage in hiring because the eco- 11 nomic success of Taiwan has rendered it ineligible 12 for financial assistance from such institutions. 13 SEC. 3. FAIRNESS FOR TAIWANESE NATIONALS REGARDING 14 EMPLOYMENT AT INTERNATIONAL FINAN- 15 CIAL INSTITUTIONS. 16 (a) IN GENERAL.—The Secretary of the Treasury 17 shall instruct the United States Executive Director at each 18 international financial institution to use the voice and vote 19 of the United States to seek to ensure that Taiwanese na- 20 tionals are not discriminated against in any employment 21 decision by the institution, including employment through 22 consulting or part-time opportunities, on the basis of— 23 (1) whether they are citizens or nationals of, or 24 holders of a passport issued by, a member country 25 VerDate Sep 11 2014 04:38 Mar 03, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H6014.IH H6014 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 6014 IH of, or a state or other jurisdiction that receives as- 1 sistance from, the international financial institution; 2 or 3 (2) any other consideration that, in the deter- 4 mination of the Secretary, unfairly disadvantages 5 Taiwanese nationals with respect to employment at 6 the institution. 7 (b) INTERNATIONAL FINANCIAL INSTITUTION DE- 8 FINED.—In this section, the term ‘‘international financial 9 institution’’ has the meaning given the term in section 10 1701(c)(2) of the International Financial Institutions Act. 11 (c) WAIVER AUTHORITY.—The Secretary of the 12 Treasury may waive subsection (a) for not more than 1 13 year at a time after reporting to the Committee on Finan- 14 cial Services of the House of Representatives and the 15 Committee on Foreign Relations of the Senate that pro- 16 viding the waiver— 17 (1) will substantially promote the objective of 18 equitable treatment for Taiwanese nationals at the 19 international financial institutions; or 20 (2) is in the national interest of the United 21 States, with a detailed explanation of the reasons 22 therefor. 23 (d) PROGRESS REPORT.—The Chairman of the Na- 24 tional Advisory Council on International Monetary and Fi- 25 VerDate Sep 11 2014 21:31 Mar 04, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H6014.IH H6014 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 6014 IH nancial Policies shall submit to the committees specified 1 in subsection (c) an annual report, in writing, that de- 2 scribes the progress made toward advancing the policy de- 3 scribed in subsection (a), and a summary of employment 4 trends with respect to Taiwanese nationals at the inter- 5 national financial institutions. 6 (e) SUNSET.—The preceding provisions of this sec- 7 tion shall have no force or effect beginning with the earlier 8 of— 9 (1) the date that is 7 years after the date of the 10 enactment of this Act; or 11 (2) the date that the Secretary of the Treasury 12 reports to the committees specified in subsection (c) 13 that each international financial institution has 14 adopted the policy described in subsection (a). 15 Æ VerDate Sep 11 2014 04:38 Mar 03, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H6014.IH H6014 kjohnson on DSK79L0C42PROD with BILLS
