following bill; which was referred to the Committee on the Judiciary
A BILL
To amend section 923 of title 18, United States Code, to
require an electronic, searchable database of the importa-
tion, production, shipment, receipt, sale, or other disposi-
tion of firearms.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Crime Gun Tracing
4
Modernization Act of 2020’’.
5
SEC. 2. ELECTRONIC, SEARCHABLE DATABASES.

Section 923(g) of title 18, United States Code, is
7
amended by adding at the end the following:

‘‘(8)(A) In this paragraph, the term ‘foreign in-
1
telligence information’ has the meaning given the
2
term in section 101 of the Foreign Intelligence Sur-
3
veillance Act of 1978 (50 U.S.C. 1801).
4
‘‘(B) Not later than 3 years after the date of
5
enactment of this paragraph, the National Tracing
6
Center of the Bureau of Alcohol, Tobacco, Firearms
7
and Explosives shall establish and maintain elec-
8
tronic, searchable databases of all records within its
9
possession of the importation, production, shipment,
10
receipt, sale, or other disposition of firearms re-
11
quired to be submitted to the Bureau of Alcohol, To-
12
bacco, Firearms and Explosives by persons licensed
13
under this chapter.

‘‘(C) Each licensee under this chapter may pro-
15
vide the National Tracing Center with electronic ac-
16
cess, consistent with the requirements of this para-
17
graph, to all records within the licensee’s possession
18
that are required to be kept under this chapter.
19
‘‘(D) A licensee may voluntarily relinquish pos-
20
session of any non-electronic record required to be
21
kept under this chapter to the Bureau of Alcohol,
22
Tobacco, Firearms and Explosives.

‘‘(E) The National Tracing Center—

‘‘(i) shall have remote access to and may

query, search, or otherwise access the electronic
2
databases described in this paragraph; and
3
‘‘(ii) may, with the permission of a State,
4
or political subdivision of a State, have remote
5
access to, and may query, search, or otherwise
6
access the databases of the firearms registra-
7
tion system or pawnbroker records system of
8
the State or political subdivision.

‘‘(F) The National Tracing Center may query,
10
search, or otherwise access the electronic databases
11
described in this paragraph for only the following
12
purposes:
13
‘‘(i) To obtain information related to any
14
Federal, State, local, tribal, or foreign crime.
15
‘‘(ii) To obtain information that is—
16
‘‘(I) foreign intelligence information;
17
or
18
‘‘(II) necessary to understand, or as-
19
sess the importance of, foreign intelligence
20
information.
21
‘‘(G) The databases established under this
22
paragraph—
23
‘‘(i) shall be electronically searchable by
24
date of disposition, license number, and the in-

formation identified on each firearm or other
1
firearm descriptor, including the manufacturer,
2
importer, model, serial number, type, and cal-
3
iber or gauge;
4
‘‘(ii) shall not be electronically searchable
5
by the personally identifiable information of any
6
individual; and
7
‘‘(iii) shall include in search results the en-
8
tire contents of the relevant records kept by the
9
licensee.

‘‘(H) This paragraph shall take effect notwith-
11
standing any other provision of law, including any
12
temporary or permanent restrictions placed on funds
13
made available to the Bureau of Alcohol, Tobacco,
14
Firearms and Explosives, or the Department of Jus-
15
tice.’’.
