Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Saving America’s Fu- 4 ture by Educating Kids Act of 2020’’. 5 SEC. 2. EVIDENCE-BASED CURRICULUM ON SUBSTANCE 6 USE DISORDERS. 7 (a) IN GENERAL.— 8 VerDate Sep 11 2014 04:14 Feb 28, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S3344.IS S3344 kjohnson on DSK79L0C42PROD with BILLS 2 •S 3344 IS (1) DEVELOPMENT AND DISSEMINATION OF 1 CURRICULUM.—The Secretary of Education, in con- 2 sultation with the partners described in paragraph 3 (2), shall develop and disseminate an evidence-based 4 curriculum for kindergarten through grade 12 on 5 educating students at an age-appropriate level on 6 the dangers and harmful impacts of substances 7 that— 8 (A) focuses on opioid and other substances 9 misuse and abuse; and 10 (B) includes vaping, e-cigarettes, tobacco, 11 and other substances. 12 (2) PARTNERS.—The partners described in this 13 paragraph are the following: 14 (A) The Assistant Secretary of the Sub- 15 stance Abuse and Mental Health Services Ad- 16 ministration. 17 (B) The Director of the Centers for Dis- 18 ease Control and Prevention. 19 (C) The Assistant Secretary of the Admin- 20 istration for Children and Families. 21 (D) The Commissioner of Food and Drugs. 22 (E) The Director of the National Institute 23 on Drug Abuse or a designee of the Director 24 from the National Institute on Drug Abuse. 25 VerDate Sep 11 2014 04:14 Feb 28, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S3344.IS S3344 kjohnson on DSK79L0C42PROD with BILLS 3 •S 3344 IS (F) The Director of the National Institute 1 on Alcohol Abuse and Alcoholism or a designee 2 of the Director from the National Institute on 3 Alcohol Abuse and Alcoholism. 4 (G) The Administrator of the Office of Ju- 5 venile Justice and Delinquency Prevention of 6 the Department of Justice or a designee of the 7 Administrator from the Office of Juvenile Jus- 8 tice and Delinquency Prevention. 9 (3) REVIEW AND UPDATE.—The Secretary of 10 Education, in consultation with the partners de- 11 scribed in paragraph (2), shall review and update 12 the evidence-based curriculum developed under para- 13 graph (1) every 2 years. 14 (b) COMPETITIVE GRANT PROGRAM.— 15 (1) IN GENERAL.—Beginning the first fiscal 16 year following the completion of the development of 17 the evidence-based curriculum under subsection 18 (a)(1), the Secretary of Education shall award 19 grants, on a competitive basis, to State educational 20 agencies to enable the State educational agencies to 21 implement the evidence-based curriculum. The Sec- 22 retary of Education shall award not less than 10 23 grants during each grant cycle. 24 VerDate Sep 11 2014 04:14 Feb 28, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S3344.IS S3344 kjohnson on DSK79L0C42PROD with BILLS 4 •S 3344 IS (2) APPLICATION.—A State educational agency 1 that desires to receive a grant under this subsection 2 shall submit an application to the Secretary of Edu- 3 cation at such time, in such manner, and accom- 4 panied by such information as the Secretary may re- 5 quire. 6 (3) PREFERENCE.—In awarding grants under 7 this subsection, the Secretary of Education shall give 8 preference to States that have experienced the high- 9 est drug overdose death rate per capita. 10 (4) SUBCONTRACT.—A State educational agen- 11 cy that receives a grant under this subsection may 12 subcontract with community coalitions, that are or 13 have been a recipient of a grant under section 1032 14 of the Anti-Drug Abuse Act of 1988 (21 U.S.C. 15 1532), to implement the evidence-based curriculum, 16 as needed. 17 (5) ANNUAL REPORT.—Each State educational 18 agency that receives a grant under this subsection 19 shall provide an annual report to the Secretary of 20 Education on measures set by the Secretary to mon- 21 itor the quality of implementation of the evidence- 22 based curriculum. 23 (c) DEFINITIONS.—In this section: 24 VerDate Sep 11 2014 04:14 Feb 28, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S3344.IS S3344 kjohnson on DSK79L0C42PROD with BILLS 5 •S 3344 IS (1) EVIDENCE-BASED.—The term ‘‘evidence- 1 based’’ has the meaning given the term in section 2 8101 of the Elementary and Secondary Education 3 Act of 1965 (20 U.S.C. 7801). 4 (2) STATE EDUCATIONAL AGENCY.—The term 5 ‘‘State educational agency’’ has the meaning given 6 the term in section 8101 of the Elementary and Sec- 7 ondary Education Act of 1965 (20 U.S.C. 7801). 8 (d) FUNDING.—There are authorized to be appro- 9 priated to carry out this section such sums as may be nec- 10 essary for the period of fiscal years 2021 through 2030. 11 Æ VerDate Sep 11 2014 04:14 Feb 28, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\S3344.IS S3344 kjohnson on DSK79L0C42PROD with BILLS
