the following bill; which was read twice and referred to the Committee
on the Judiciary
A BILL
To amend the Controlled Substances Act to prohibit the
deceptive sale of fentanyl, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ββZero Tolerance for De-
4
ceptive Fentanyl Trafficking Actββ.

SEC. 2. PROHIBITION OF THE DECEPTIVE SALE OF
6
FENTANYL.

Section 401 of the Controlled Substances Act (21
8
U.S.C. 841) is amended by adding at the end the fol-
9
lowing:

DECEPTIVE
SALE

FENTANYL
AND

FENTANYL-RELATED SUBSTANCES.β

ββ(1) OFFENSE.βIt shall be unlawful for any
3
person to knowingly misrepresent or knowingly mar-
4
ket as another substance a mixture or substance
5
containing fentanyl, a fentanyl analogue, or a
6
fentanyl-related substance (as defined in subsection
7
(e)(2) of Schedule I in section 202(c)).

ββ(2) PENALTY.β
9
ββ(A) IN GENERAL.βExcept as provided in
10
subparagraph (B), any person who violates
11
paragraph (1) shall be imprisoned for not less
12
than 20 years and fined under title 18, United
13
States Code.

ββ(B) ENHANCED PENALTIES.β
15
ββ(i) DEATH RESULTS.βIn the case of
16
a violation of paragraph (1) in which death
17
results from the violation, or the person
18
commits the violation with the intent to
19
cause death, the person shall be punished
20
by death or by a sentence of imprisonment
21
for life and fined under title 18, United
22
States Code.

ββ(ii) PRIOR FELONY CONVICTION OR

UNLAWFUL

SEC. 3. FENTANYL-RELATED SUBSTANCES.

Section 202(c) of the Controlled Substances Act (21
11
U.S.C. 812) is amendedβ
12
(1) by adding at the end of subsection (b) of
13
Schedule I the following:

ββ(23) Isobutyryl fentanyl.
15
ββ(24) Para-Methoxybutyrylfentanyl.
16
ββ(25) Valeryl fentanyl.
17
ββ(26) Cyclopentyl fentanyl.
18
ββ(27) Para-Chloroisobutyryl fentanyl.ββ; and
19
(2) by adding at the end of Schedule I the fol-
20
lowing:

ββ(e)(1) Unless specifically exempted or unless listed
22
in another schedule, any material, compound, mixture, or
23
preparation which contains any quantity of fentanyl-re-
24
lated substances, or which contains their salts, isomers,

and salts of isomers whenever the existence of such salts,
1
isomers, and salts of isomers is possible within the specific
2
chemical designation.

ββ(2) In paragraph (1), the term βfentanyl-related sub-
4
stancesβ includes the following:
5
ββ(A) Any substance that is structurally related
6
to fentanyl by one or more of the following modifica-
7
tions:
8
ββ(i) By replacement of the phenyl portion
9
of the phenethyl group by any monocycle,
10
whether or not further substituted in or on the
11
monocycle.
12
ββ(ii) By substitution in or on the phenethyl
13
group with alkyl, alkenyl, alkoxy, hydroxy, halo,
14
haloalkyl, amino or nitro groups.
15
ββ(iii) By substitution in or on the piper-
16
idine ring with alkyl, alkenyl, alkoxy, ester,
17
ether, hydroxy, halo, haloalkyl, amino or nitro
18
groups.
19
ββ(iv) By replacement of the aniline ring
20
with any aromatic monocycle whether or not
21
further substituted in or on the aromatic mono-
22
cycle.
23
ββ(v) By replacement of the N-propionyl
24
group by another acyl group.
