Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Zero Tolerance for De- 4 ceptive Fentanyl Trafficking Act’’. 5 SEC. 2. PROHIBITION OF THE DECEPTIVE SALE OF 6 FENTANYL. 7 Section 401 of the Controlled Substances Act (21 8 U.S.C. 841) is amended by adding at the end the fol- 9 lowing: 10 VerDate Sep 11 2014 04:13 Feb 28, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S3342.IS S3342 kjohnson on DSK79L0C42PROD with BILLS 2 •S 3342 IS ‘‘(i) DECEPTIVE SALE OF FENTANYL AND 1 FENTANYL-RELATED SUBSTANCES.— 2 ‘‘(1) OFFENSE.—It shall be unlawful for any 3 person to knowingly misrepresent or knowingly mar- 4 ket as another substance a mixture or substance 5 containing fentanyl, a fentanyl analogue, or a 6 fentanyl-related substance (as defined in subsection 7 (e)(2) of Schedule I in section 202(c)). 8 ‘‘(2) PENALTY.— 9 ‘‘(A) IN GENERAL.—Except as provided in 10 subparagraph (B), any person who violates 11 paragraph (1) shall be imprisoned for not less 12 than 20 years and fined under title 18, United 13 States Code. 14 ‘‘(B) ENHANCED PENALTIES.— 15 ‘‘(i) DEATH RESULTS.—In the case of 16 a violation of paragraph (1) in which death 17 results from the violation, or the person 18 commits the violation with the intent to 19 cause death, the person shall be punished 20 by death or by a sentence of imprisonment 21 for life and fined under title 18, United 22 States Code. 23 ‘‘(ii) PRIOR FELONY CONVICTION OR 24 UNLAWFUL PRESENCE IN THE UNITED 25 VerDate Sep 11 2014 04:13 Feb 28, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S3342.IS S3342 kjohnson on DSK79L0C42PROD with BILLS 3 •S 3342 IS STATES.—A person who violates paragraph 1 (1) shall be sentenced to imprisonment for 2 life and fined under title 18, United States 3 Code, if the violation occurs— 4 ‘‘(I) after any other prior felony 5 conviction of the person has become 6 final; or 7 ‘‘(II) while the person is unlaw- 8 fully present in the United States.’’. 9 SEC. 3.
