Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. FORFEITURE OF PENSION. 1 Section 8332(o) of title 5, United States Code, is 2 amended by adding at the end the following: 3 ‘‘(7)(A) Subject to subparagraph (B), an individual 4 convicted of an offense described in paragraph (2) shall 5 not, between the date of sentencing and the date of final 6 conviction for such offense, be eligible to receive any pay- 7 ment of an annuity pursuant to the retirement system 8 under this subchapter or chapter 84, except that this sen- 9 tence applies only to such payments based on service ren- 10 dered as a Member (irrespective of when rendered). 11 ‘‘(B) If the conviction of an individual described in 12 subparagraph (A) is held to be invalid, such individual 13 shall receive payments that such individual would have re- 14 ceived but for application of subparagraph (A). 15 ‘‘(C) The provisions of this paragraph only apply to 16 a conviction that occurs after the date of enactment of 17 this paragraph.’’. 18 Æ VerDate Sep 11 2014 20:01 Feb 27, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\H5980.IH H5980 khammond on DSKJM1Z7X2PROD with BILLS
