Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Safe Routes to School 4 Expansion Act’’. 5 SEC. 2. HIGHWAY SAFETY IMPROVEMENT PROGRAM. 6 Section 148 of title 23, United States Code, is 7 amended— 8 (1) in subsection (a)— 9 VerDate Sep 11 2014 21:29 Feb 21, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H5891.IH H5891 khammond on DSKJM1Z7X2PROD with BILLS 2 •HR 5891 IH (A) in paragraph (4)(B)— 1 (i) by striking clause (xviii) and in- 2 serting the following: 3 ‘‘(xviii) Safe Routes to School infra- 4 structure related projects, as defined in 5 section 1404(f) of SAFETEA–LU (23 6 U.S.C. 402 note).’’; 7 (ii) in clause (xxvi) by inserting ‘‘or 8 leading pedestrian intervals’’ after ‘‘bea- 9 cons’’; 10 (iii) by redesignating clause (xxviii) as 11 clause (xxix); 12 (iv) by inserting after clause (xxvii) 13 the following: 14 ‘‘(xxviii) Installation of infrastructure 15 improvements that create safe routes to 16 bus stops including sidewalks, crosswalks, 17 signage, and bus stop shelters or protected 18 waiting areas.’’; and 19 (v) in clause (xxix), as redesignated, 20 by striking ‘‘(xxvii)’’ and inserting 21 ‘‘(xxviii)’’; 22 (B) by redesignating paragraphs (10) 23 through (12) as paragraphs (11) through (13), 24 respectively; 25 VerDate Sep 11 2014 01:54 Feb 20, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H5891.IH H5891 khammond on DSKJM1Z7X2PROD with BILLS 3 •HR 5891 IH (C) by inserting after paragraph (9) the 1 following: 2 ‘‘(10) SAFETY PROJECT UNDER ANY OTHER 3 SECTION.— 4 ‘‘(A) IN GENERAL.—The term ‘safety 5 project under any other section’ means a 6 project carried out for the purposes of safety 7 under any section of this title other than this 8 section. 9 ‘‘(B) INCLUSION.—The term ‘safety 10 project under any other section’ includes a 11 project, consistent with the State strategic high- 12 way safety plan, that— 13 ‘‘(i) promotes public awareness and 14 informs the public regarding highway safe- 15 ty matters (including motorcycle safety 16 and school bus stop safety); 17 ‘‘(ii) facilitates enforcement of traffic 18 safety laws; and 19 ‘‘(iii) supports Safe Routes to School 20 non-infrastructure projects, as defined in 21 section 1404(f) of SAFETEA–LU (23 22 U.S.C. 402 note).’’; and 23 (D) in paragraph (12)(A), as so redesig- 24 nated— 25 VerDate Sep 11 2014 01:54 Feb 20, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H5891.IH H5891 khammond on DSKJM1Z7X2PROD with BILLS 4 •HR 5891 IH (i) in clause (ix) by striking ‘‘and’’; 1 (ii) by redesignating clause (x) as 2 clause (xi); and 3 (iii) by inserting after clause (ix) the 4 following: 5 ‘‘(x) State or local representatives of 6 educational agencies to address Safe 7 Routes to School and school bus safety; 8 and’’; 9 (2) in subsection (c)(1)(A) by striking ‘‘(11)’’ 10 and inserting ‘‘(12)’’; 11 (3) in subsection (d)(2)(B)(i) by striking 12 ‘‘(11)’’ and inserting ‘‘(12)’’; and 13 (4) in subsection (e) by adding at the end the 14 following: 15 ‘‘(3) FLEXIBLE FUNDING FOR SAFETY 16 PROJECTS UNDER ANY OTHER SECTION.— 17 ‘‘(A) IN GENERAL.—To advance the imple- 18 mentation of a State strategic highway plan, a 19 State may use not more than 25 percent of the 20 amounts apportioned to the State under section 21 104(b)(3) for a fiscal year to carry out safety 22 projects under any other section. 23 ‘‘(B) OTHER TRANSPORTATION AND SAFE- 24 TY PLANS.—Nothing in this paragraph requires 25 VerDate Sep 11 2014 01:54 Feb 20, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H5891.IH H5891 khammond on DSKJM1Z7X2PROD with BILLS 5 •HR 5891 IH a State to revise any State process, plan, or 1 program in effect on the date of enactment of 2 this paragraph.’’. 3 SEC. 3.
