following bill; which was read twice and referred to the Committee on
Health, Education, Labor, and Pensions
A BILL
To improve the operation of the Organ Procurement and
Transplantation Network.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Lost Opportunities to
4
Supply Transplantable Organs Act of 2020’’ or the
5
‘‘LOST Organs Act of 2020’’.
6
SEC. 2. ORGAN PROCUREMENT AND TRANSPLANTATION
7
NETWORK.

Section 372(b)(2) of the Public Health Service Act
9
(42 U.S.C. 274(b)(2)) is amended—

(1) in subparagraph (E), by inserting ‘‘and

practice’’ after ‘‘quality’’;

(2) by moving subparagraphs (M) through (O)

of personal identifiers of donors, waitlist candidates,

and recipients, on the status of all organs in trans-

port from organ procurement organizations to any
13
location within the transplant supply chain, includ-
14
ing transplant centers,
15
‘‘(I) in the event that an organ is lost, dam-
16
aged, or delayed in transport, establish an open and
17
transparent process to determine cause, corrective
18
action, and recommendations for updates to the
19
standards of quality and practice under subpara-
20
graph (E) to prevent organs from being lost, dam-
21
aged, or delayed,’’.
