SHORT TITLE. 1 This Act may be cited as the ‘‘Bipartisan Solution 2 to Cyclical Violence Act of 2020’’. 3 SEC. 2. GRANT PROGRAM SUPPORTING TRAUMA CENTER 4 VIOLENCE INTERVENTION AND VIOLENCE 5 PREVENTION PROGRAMS. 6 Part P of title III of the Public Health Service Act 7 (42 U.S.C. 280g et seq.) is amended by adding at the end 8 the following new section: 9 ‘‘SEC. 399V–7. GRANT PROGRAM SUPPORTING TRAUMA CEN- 10 TER VIOLENCE INTERVENTION AND VIO- 11 LENCE PREVENTION PROGRAMS. 12 ‘‘(a) AUTHORITY ESTABLISHED.— 13 ‘‘(1) IN GENERAL.—The Secretary shall award 14 grants to eligible entities to establish or expand vio- 15 lence intervention or prevention programs for serv- 16 ices and research designed to reduce the incidence of 17 reinjury and reincarceration caused by intentional 18 violent trauma, excluding intimate partner violence. 19 ‘‘(2) FIRST AWARD.—Not later than 9 months 20 after the date of enactment of this section, the Sec- 21 retary shall make the first award under paragraph 22 (1). 23 ‘‘(3) GRANT DURATION.—Each grant awarded 24 under paragraph (1) shall be for a period of three 25 years. 26 VerDate Sep 11 2014 18:20 Nov 19, 2020 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H5855.RFS H5855 pamtmann on DSKBC07HB2PROD with BILLS 3 HR 5855 RFS ‘‘(4) GRANT AMOUNT.—The total amount of 1 each grant awarded under paragraph (1) for the 3- 2 year grant period shall be not less than $250,000 3 and not more than $500,000. 4 ‘‘(5) SUPPLEMENT NOT SUPPLANT.—A grant 5 awarded under paragraph (1) to an eligible entity 6 with an existing program described in paragraph (1) 7 shall be used to supplement, and not supplant, any 8 other funds provided to such entity for such pro- 9 gram. 10 ‘‘(b) ELIGIBLE ENTITIES.—To be eligible to receive 11 a grant under subsection (a)(1), an entity shall— 12 ‘‘(1) either be— 13 ‘‘(A) a State-designated trauma center, or 14 a trauma center verified by the American Col- 15 lege of Surgeons, that conducts or seeks to con- 16 duct a violence intervention or violence preven- 17 tion program; or 18 ‘‘(B) a nonprofit entity that conducts or 19 seeks to conduct a program described in sub- 20 paragraph (A) in cooperation with a trauma 21 center described in such subparagraph; 22 ‘‘(2) serve a community in which at least 100 23 incidents of intentional violent trauma occur annu- 24 ally; and 25 VerDate Sep 11 2014 18:20 Nov 19, 2020 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H5855.RFS H5855 pamtmann on DSKBC07HB2PROD with BILLS 4 HR 5855 RFS ‘‘(3) submit to the Secretary an application at 1 such time, in such manner, and containing such in- 2 formation as the Secretary may require. 3 ‘‘(c) SELECTION OF GRANT RECIPIENTS.— 4 ‘‘(1) GEOGRAPHIC DIVERSITY.—In selecting 5 grant recipients under subsection (a)(1), the Sec- 6 retary shall ensure that collectively grantees rep- 7 resent a diversity of geographic areas. 8 ‘‘(2) PRIORITY.—In selecting grant recipients 9 under subsection (a)(1), the Secretary shall 10 prioritize applicants that serve one or more commu- 11 nities with high absolute numbers or high rates of 12 intentional violent trauma. 13 ‘‘(3) HEALTH PROFESSIONAL SHORTAGE 14 AREAS.— 15 ‘‘(A) ENCOURAGEMENT.—The Secretary 16 shall encourage entities described in paragraphs 17 (1) and (2) that are located in or serve a health 18 professional shortage area to apply for grants 19 under subsection (a)(1). 20 ‘‘(B) DEFINITION.—In subparagraph (A), 21 the term ‘health professional shortage area’ 22 means a health professional shortage area des- 23 ignated under section 332. 24 ‘‘(d) REPORTS.— 25 VerDate Sep 11 2014 18:20 Nov 19, 2020 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H5855.RFS H5855 pamtmann on DSKBC07HB2PROD with BILLS 5 HR 5855 RFS ‘‘(1) REPORTS TO SECRETARY.— 1 ‘‘(A) IN GENERAL.—An entity that re- 2 ceives a grant under subsection (a)(1) shall 3 submit reports on the use of the grant funds to 4 the Secretary, including progress reports, as re- 5 quired by the Secretary. Such reports shall in- 6 clude— 7 ‘‘(i) any findings of the program es- 8 tablished, or expanded, by the entity 9 through the grant; and 10 ‘‘(ii) if applicable, the manner in 11 which the entity has incorporated such 12 findings in the violence intervention or vio- 13 lence prevention program conducted by 14 such entity. 15 ‘‘(B) OPTION FOR JOINT REPORT.—To the 16 extent feasible and appropriate, an entity that 17 receives a grant under subsection (a)(1) may 18 elect to coordinate with one or more other enti- 19 ties that have received such a grant to submit 20 a joint report that meets the requirements of 21 subparagraph (A). 22 ‘‘(2) REPORT TO CONGRESS.—Not later than 23 six years after the date of enactment of the Bipar- 24 VerDate Sep 11 2014 18:20 Nov 19, 2020 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H5855.RFS H5855 pamtmann on DSKBC07HB2PROD with BILLS 6 HR 5855 RFS tisan Solution to Cyclical Violence Act of 2020, the 1 Secretary shall submit to Congress a report— 2 ‘‘(A) on any findings resulting from re- 3 ports submitted to the Secretary under para- 4 graph (1); 5 ‘‘(B) on best practices developed by the 6 Secretary under subsection (e); and 7 ‘‘(C) with recommendations for legislative 8 action relating to intentional violent trauma 9 prevention that the Secretary determines appro- 10 priate. 11 ‘‘(e) BEST PRACTICES.—Not later than six years 12 after the date of enactment of the Bipartisan Solution to 13 Cyclical Violence Act of 2020, the Secretary shall— 14 ‘‘(1) develop, and post on a public website of 15 the Department of Health and Human Services, best 16 practices for intentional violent trauma prevention, 17 based on any findings reported to the Secretary 18 under subsection (d)(1); and 19 ‘‘(2) disseminate such best practices to stake- 20 holders, as determined appropriate by the Secretary. 21 ‘‘(f) AUTHORIZATION OF APPROPRIATIONS.—To 22 carry out this section, there is authorized to be appro- 23 VerDate Sep 11 2014 18:20 Nov 19, 2020 Jkt 019200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H5855.RFS H5855 pamtmann on DSKBC07HB2PROD with BILLS 7 HR 5855 RFS priated $10,000,000 for the period of fiscal years 2021 1 through 2024.’’. 2 Passed the House of Representatives November 17, 2020.
