SHORT TITLE. 1 This Act may be cited as the ‘‘Promoting Secure 5G 2 Act of 2020’’. 3 SEC. 2. UNITED STATES POLICY REGARDING INTER- 4 NATIONAL FINANCIAL INSTITUTION ASSIST- 5 ANCE WITH RESPECT TO ADVANCED WIRE- 6 LESS TECHNOLOGIES. 7 (a) IN GENERAL.—The Secretary of the Treasury (in 8 this section referred to as the ‘‘Secretary’’) shall instruct 9 the United States Executive Director at each international 10 financial institution (as defined in section 1701(c)(2) of 11 the International Financial Institutions Act) that it is the 12 policy of the United States to— 13 (1) support assistance by the institution with 14 respect to advanced wireless technologies (such as 15 5th generation wireless technology for digital cellular 16 networks and related technologies) only if the tech- 17 nologies provide appropriate security for users; 18 (2) proactively encourage assistance with re- 19 spect to infrastructure or policy reforms that facili- 20 tate the use of secure advanced wireless tech- 21 nologies; and 22 (3) cooperate, to the maximum extent prac- 23 ticable, with member states of the institution, par- 24 ticularly with United States allies and partners, in 25 VerDate Sep 11 2014 03:58 Sep 23, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H5698.RFS H5698 pamtmann on DSKBC07HB2PROD with BILLS 3 HR 5698 RFS order to strengthen international support for such 1 technologies. 2 (b) WAIVER AUTHORITY.—The Secretary may waive 3 subsection (a) on a case-by-case basis, on reporting to the 4 Committee on Financial Services of the House of Rep- 5 resentatives and the Committee on Foreign Relations of 6 the Senate that the waiver— 7 (1) will allow the United States to effectively 8 promote the objectives of the policy described in sub- 9 section (a); or 10 (2) is in the national interest of the United 11 States, with an explanation of the reasons therefor. 12 (c) PROGRESS REPORT.—The Chairman of the Na- 13 tional Advisory Council on International Monetary and Fi- 14 nancial Policies shall include in the annual report required 15 by section 1701 of the International Financial Institutions 16 Act a description of progress made toward advancing the 17 policy described in subsection (a) of this section. 18 (d) SUNSET.—The preceding provisions of this sec- 19 tion shall have no force or effect after the earlier of— 20 (1) the date that is 7 years after the date of the 21 enactment of this Act; or 22 (2) the date that the Secretary reports to the 23 committees specified in subsection (b) that termi- 24 nating the effectiveness of the provisions is impor- 25 VerDate Sep 11 2014 03:58 Sep 23, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H5698.RFS H5698 pamtmann on DSKBC07HB2PROD with BILLS 4 HR 5698 RFS tant to the national interest of the United States, 1 with a detailed explanation of the reasons therefor. 2 Passed the House of Representatives September 21, 2020.
