JAYAPAL, and Ms. SCHRIER) introduced the following bill; which was re-
ferred to the Committee on Transportation and Infrastructure
A BILL
To require the Secretary of Transportation to set aside cer-
tain amounts provided under the BUILD program for
rural areas, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Better Utilizing Invest-
4
ments to Leverage Development for Underfunded Projects
5
Act’’ or the ‘‘BUILD UP Act’’.
6
SEC. 2. SET-ASIDE FOR BUILD GRANT AMOUNTS.

(a) IN GENERAL.—With respect to grant amounts
8
provided under the heading ‘‘Office of the Secretary—Na-

tional Infrastructure Investments’’ in title I of division H

of the Further Consolidated Appropriations Act, 2020
2
(Public Law 116–94) for eligible projects, the Secretary
3
of Transportation shall ensure that not less than 30 per-
4
cent of the amount provided under such heading shall be
5
provided to cities with populations of between 10,000 and
6
75,000, whether or not 1 or more of such cities are consid-
7
ered part of an urbanized area as designated by the
8
United States Census Bureau.

(b) ELIGIBLE PROJECT DEFINED.—In this section,
10
the term ‘‘eligible project’’ means a project eligible for
11
funding under title I of division H of the Further Consoli-
12
dated Appropriations Act, 2020 (Public Law 116–94), in-
13
cluding—
14
(1) a highway or bridge project eligible under
15
title 23, United States Code;
16
(2) a public transportation project eligible
17
under chapter 53 of title 49, United States Code;
18
(3) a passenger and freight rail transportation
19
project eligible under title 23 or title 49, United
20
States Code;
21
(4) a port infrastructure investment (including
22
inland port infrastructure and land ports of entry)
23
eligible under title 23, United States Code, chapter
